In development projects that have both single-family and multifamily <br /> housing types, 25 percent shall apply only to the multifamily units, and any single- <br /> family units that are within a multifamily development but are own their own parcel <br /> are subject to regulations applicable to accessory dwelling units for single-family <br /> developments. If the multifamily unit is eligible for an accessory dwelling unit, the <br /> accessory dwelling unit resulting from the conversion of space may be located in <br /> either the multifamily unit or in the single-family unit. <br /> • The text leading to the standards for second story ADUs in Section 18.106.060(C) was <br /> simplified. <br /> • Removed "attached or detached" at the beginning of Section 18.106.060(C)(4) to <br /> simplify the text (omission of this phrase implies the standards applies to both attached <br /> and detached ADUs): <br /> Attached and detached accessory dwelling units shall incorporate roof and <br /> exterior wall material, building color(s), trim that matches the primary dwelling <br /> structure to the maximum extent feasible. <br /> • Modified reference in PMC sections 18.106.040(A) and 18.106.045(A) to say, <br /> 18.106.060(C)(2). This is to correct a reference error. <br /> PUBLIC NOTICE AND PUBLIC COMMENTS <br /> Notification of this code amendment has been published in The Valley Times as an upcoming <br /> agenda item for the July 8, 2020, Planning Commission meeting. The Planning Commission <br /> continued its meeting of June 24, 2020 to a date certain of July 8, 2020. As part of the June <br /> 24, 2020, meeting, the Planning Commission received an email from a local developer <br /> advocating to eliminate enforcement of deed restrictions that require owner occupancy for <br /> ADUs approved before January 1 of this year. At the time this report was prepared, staff has <br /> not received additional comments regarding the proposed code amendments. Staff does, <br /> however, continue to receive numerous inquiries from the public, interested in ADUs and <br /> standards specific to Pleasanton. <br /> ENVIRONMENTAL ASSESSMENT <br /> The proposed code amendments are statutorily exempt from the provisions of the California <br /> Environmental Quality Act (CEQA) pursuant Public Resources Code Section 21080.17 and <br /> categorically exempt per CEQA Guidelines Section 15303. <br /> SUMMARY/CONCLUSION <br /> The proposed text amendments will facilitate the development of ADUs and bring the PMC into <br /> compliance with State law.
