PLANNING COMMISSION CITY OF PLEASANTON
ALAMEDA COUNTY, CALIFORNIA
RESOLUTION NO. PC-2003 53
RESOLUTION DENYING THE APPLICATION OF GLENN KIERSTEAD, CALIFORNIA
SPLASH LLC, FOR CONDITIONAL USE PERMIT AND DESIGN REVIEW APPROVALS,
AS FILED UNDER CASE PCUP-63/PDR-243
WHEREAS, Glenn Kierstead/California Splash has applied for conditional use permit and design
review approvals to expand the existing water park facilities and related improvements at
Shadow Cliffs Regional Recreation Area located at 2500 and 3320 Stanley Boulevard;
and
WHEREAS, zoning for the property is Public and Institutional (P) District; and
WHEREAS, at its duly noticed public hearing of December 10, 2003, the Planning Commission
considered all public testimony, relevant exhibits, and recommendations of the City staff
concerning this application; and
WHEREAS, East Bay Regional Park District was the lead agency for the project and adopted a
Mitigated Negative Declaration.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON
RESOLVES THE FOLLOWING:
Section 1. Denies Case PCUP-63/PDR-243, the application of Glenn Kierstead/California Splash
for conditional use permit and design review approvals to expand the existing water park
facilities and related improvements at Shadow Cliffs Regional Recreation Area located at
2500 and 3320 Stanley Boulevard, because the Planning Commission cannot make the
required Conditional Use findings. In particular, the Planning Commission questions the
compatibility of the project with adjoining uses and finds that impacts of the project
would be detrimental to the public health, welfare, and safety. The Commission suggests
that the applicant submit a new, smaller, phased plan, including a smaller Phase I, which
addresses the Commission's concerns, including traffic impacts, noise, and parking.
Section 2. This resolution shall become effective 15 days after its passage and adoption unless
appealed prior to that time.
