It is very likely the state will be issuing <br /> clear guidance on payment of back rent by Judicial Order, Governor's Executive Order, or <br /> legislation. Staff recommended supporting statewide and countywide efforts. <br /> In response to Councilmember Pentin, City Attorney Sodergren said the Judicial Council adopted <br /> an order that suspended all judicial foreclosures as well. <br /> Councilmember Pentin voiced concerns for building owners who rely on rent collection as their <br /> income, to which City Attorney Sodergren replied the Judicial Council, the Governor's office, and <br /> various groups will discuss this matter and when legislature reconvenes there will be many <br /> legislative proposals emerging. <br /> City Manager Fialho added the County informed him that in their amendments to the eviction <br /> moratorium regarding residential rentals, repayment will have to occur within 12 months after the <br /> public health emergency has ended. The County will have the same discussion for commercial <br /> rentals as well. <br /> In response to Councilmember Testa, City Attorney Sodergren noted there is no forgiveness of <br /> the rent, and some ordinances provide there will be no penalty on late payments, however the <br /> Judicial Council order did not address that. <br /> In response to Councilmember Testa, City Attorney Sodergren confirmed there is nothing unique <br /> to Pleasanton in this resolution, Pleasanton did not create anything locally. The City was prepared <br /> to recommend a local measure, but the Judicial Council took action and based on the wide scope <br /> of their action, the City is not recommending a local measure at this time but will continue to <br /> monitor it. <br /> Councilmember Brown commented this emergency affects not only tenants, also landlords and <br /> building owners. She hopes tenants can make themselves whole again and this resolution assists <br /> in that. <br /> Councilmember Pentin added there is potential to do more locally, but at this time this is a good <br /> start. <br /> Councilmember Narum offered there are Federal loans available for businesses that pay rent, and <br /> those loans can be forgiven and turned into grants. There are also some incentives for landlords. <br /> Mayor Thorne added he is concerned about property owners that will be impacted and hopes <br /> Federal and State governments will do something to aid them. <br /> MOTION: It was m/s by Testa/Brown to adopt and waive full reading of Resolution No. 20-1142 <br /> supporting the statewide and countywide efforts in place to protect residential and commercial <br /> tenants from being evicted during the COVID-19 national, state and local emergency. <br /> Motion passed by the following vote: <br /> Ayes: Councilmembers Brown, Pentin, Narum, Testa, Mayor Thorne <br /> Noes: None <br /> Absent: None <br /> City Council Minutes Page 4 of 11 April 15, 2020 <br />
