Resolution No. PC-2003-50 <br />Page 4 <br />Exhibit B <br />Conditions of Approval <br />Case PCUP-99 <br />The location and operation of the proposed use shall conform substantially to <br />Exhibit "A" (the site plan, floor plans, and details of operation), dated "Received, <br />October 10, 2003", on file with the Planning Department, except as modified by <br />the following conditions. <br />2. The operation of the fitness and weight loss facility shall be limited to the <br />following hours: <br />Monday -Friday: 5:00 a.m. - 7:00 p.m. <br />Saturday -Sunday: 8:00 a.m. - 5:00 p.m. <br />3. if noise from the parking lot during early morning business hours impacts the <br />residential area to the north of the subject site, the Planning Director may require <br />that staff and patrons of the training facility park in the parking area on the south <br />side of the office complex between the hours of 5:00 a.m. and 7:00 a.m. as a <br />mitigation measure. <br />4. If additional hours of operation or activities beyond that conditioned or included <br />in the applicant's statement of operation, dated "Received, October 10, 2003", on <br />file in the Planning Department, are desired, prior City review and approval is <br />required. Such modifications may be approved by the Planning Director if found <br />to be in substantial conformance with this approval. The Planning Director may <br />also refer the matter to the Planning Commission if the proposed changes would <br />be significant. <br />5. The applicant shall pay any and all fees to which the proposed application may be <br />subject prior to issuance of building permits. The type and amount of the fees <br />shall be those in effect at the time the building permit is issued. <br />6. This conditional use permit approval will lapse one (1) year from the effective <br />date of approval unless the proposed training facility is in operation. <br />7. The building permit plan check materials for the proposed tenant improvements <br />will be accepted for submittal only after completion of the fifreen (15)- day appeal <br />period, measured for the date of the approval letter, unless the applicant submits a <br />signed statement acknowledging that the plan check fees may be forfeited in the <br />event that the approval is overturned on appeal, or that the design is significantly <br />changed as a result of the appeal In no case will a building permit be issued prior <br />to the expiration of the fifteen (15)-day time-period. <br />
