Resolution No. PC-2003-50 Page 4 Exhibit B Conditions of Approval Case PCUP-99 The location and operation of the proposed use shall conform substantially to Exhibit "A" (the site plan, floor plans, and details of operation), dated "Received, October 10, 2003", on file with the Planning Department, except as modified by the following conditions. 2. The operation of the fitness and weight loss facility shall be limited to the following hours: Monday -Friday: 5:00 a.m. - 7:00 p.m. Saturday -Sunday: 8:00 a.m. - 5:00 p.m. 3. if noise from the parking lot during early morning business hours impacts the residential area to the north of the subject site, the Planning Director may require that staff and patrons of the training facility park in the parking area on the south side of the office complex between the hours of 5:00 a.m. and 7:00 a.m. as a mitigation measure. 4. If additional hours of operation or activities beyond that conditioned or included in the applicant's statement of operation, dated "Received, October 10, 2003", on file in the Planning Department, are desired, prior City review and approval is required. Such modifications may be approved by the Planning Director if found to be in substantial conformance with this approval. The Planning Director may also refer the matter to the Planning Commission if the proposed changes would be significant. 5. The applicant shall pay any and all fees to which the proposed application may be subject prior to issuance of building permits. The type and amount of the fees shall be those in effect at the time the building permit is issued. 6. This conditional use permit approval will lapse one (1) year from the effective date of approval unless the proposed training facility is in operation. 7. The building permit plan check materials for the proposed tenant improvements will be accepted for submittal only after completion of the fifreen (15)- day appeal period, measured for the date of the approval letter, unless the applicant submits a signed statement acknowledging that the plan check fees may be forfeited in the event that the approval is overturned on appeal, or that the design is significantly changed as a result of the appeal In no case will a building permit be issued prior to the expiration of the fifteen (15)-day time-period.
