The proposed location of the conditional use and the conditions <br />under which it would be operated or maintained will not be <br />detrimental to the public health, safety, or welfare, or materially <br />injurious to the properties or improvements in the vicinity. <br />The proposed facility would have adequate off-street parking to meet the <br />demand and would not adversely impact the adjacent tenants. The <br />proposed use is to be operated entirely indoors, and its fitness programs <br />should not interfere with adjacent uses. The streets leading to the site are <br />designed per City standards and are signalized to provide safe access into <br />and out of the site. <br />The proposed conditional use will comply with each of the <br />applicable provisions of the Zoning Ordinance. <br />The site's zoning regulations conditionally permit the establishment of a <br />health club/fitness center. The proposed use complies with all relevant <br />sections of the zoning ordinance. Granting a conditional use permit to the <br />applicant for afitness/weight loss facility would be consistent with the City's <br />ability to regulate zoning as listed in the Municipal Code. <br />WHEREAS, the Planning Commission determined that the proposed use would offer a <br />service to residents of the community, would be compatible with the <br />surrounding businesses, and would not detrimentally affect the surrounding <br />uses or properties. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-98, the application of Kimberly Fox for conditional use <br />permit approval to operate a ladies fitness facility within an existing building <br />located in the Crossroads Center located at 4555 Hopyard Road, subject to the <br />conditions shown in Exhibit "B," attached hereto and made part of this case by <br />reference. <br />Section 2. This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
