Should a significant event occur, this reserve <br /> amount is likely inadequate to cover the cost of needed repairs. <br /> Proposition 218 Compliance <br /> As noted above, the proposed assessments fund geologic monitoring and related <br /> maintenance services that provide a special benefit to the properties within the GHADs, <br /> but do not benefit the public at large. In addition, the GHADs were formed by consent of <br /> all original property owners (the developers). Since these criteria have been satisfied, <br /> the GHAD assessments can be increased by an amount not to exceed the ENR index <br /> without being subject to a Proposition 218 vote of property owners. <br /> DISCUSSION <br /> At the May 19, 2020, Board of Directors meeting, the Board adopted a resolution <br /> declaring an intention to order the cost of maintenance be assessed against the <br /> property owners within each of the GHADs for FY 2020/21. As required by each GHAD. <br /> the Board of Directors must levy an annual assessment on all parcels (including any <br /> City's parcels) benefited by the GHAD. <br /> At the assessment hearing, the Board shall hear and consider all protests and make <br /> modifications, if determined necessary, to the proposed assessments. After the close of <br /> the public hearing, the Board shall confirm the assessments as submitted by the <br /> General Manager or otherwise determined, and order that the amount of each <br /> assessment be levied against all parcels within each GHAD. <br /> If the assessments are ordered, the City Clerk will record the Notice of Assessments <br /> with the Alameda County Tax Collector as provided in California Streets and Highways <br /> Code §3114. <br /> Submitted by: Fiscal Review: Approved..by: <br /> Stephen Kir trick Tina Olson Nelson Fialho <br /> Director of Engineering Director of Finance City Manager <br /> Attachments: <br /> 1.
