selling tobacco products and tobacco paraphernalia to apply for and annually renew a <br /> tobacco retailer license. <br /> Based on these examples from other communities, the proposed tobacco retailer <br /> permitting program requires businesses to comply with all local, state and federal laws <br /> regarding tobacco sales. A permit would need to be obtained and renewed each year. <br /> Penalties for violations are proposed to be aggregated over a five year period, and <br /> include suspension and revocation of ability to sell tobacco products, as well as <br /> alternate fines through settlements, typically subject to appeal. A permit can also be <br /> revoked, or not renewed, if inaccurate information is provided, or the applicant has prior <br /> violations. The table on the following page shows penalties in neighboring jurisdictions, <br /> as well as proposed penalties for Pleasanton's tobacco retailer permitting program. <br /> These proposed penalties would apply, for example, if a tobacco retailer did all three of <br /> the following violations in a five year period: <br /> 1. Sold tobacco to an underage person in January 2021 = 1st violation (of state and <br /> federal law) = permit suspended (no tobacco sales or display allowed) for 30 days; <br /> 2. Had more than 5 flavored tobacco products on premises in November 2022 = 2nd <br /> violation (of city prohibition on sale of flavored tobacco) = permit suspended 12 <br /> months; <br /> 3. Sold a pack of 4 cigars for $6 in May 2023 = 3rd violation (of city minimum package <br /> sizes and prices) = permit revoked. <br /> 3 <br />
