THE CITY OF 33 <br /> _- -• -_ " CITY COUNCIL AGENDA REPORT <br /> pL£ASANTON, <br /> June 2, 2020 <br /> Community Development <br /> Police Department <br /> Economic Development Department <br /> TITLE: CONSIDER INTRODUCING AN ORDINANCE TO AMEND PLEASANTON <br /> MUNICIPAL CODE CHAPTER 9.32 TO ADD A TOBACCO RETAILER <br /> PERMIT REQUIREMENT, AND REFERRALS TO COUNSELING FOR <br /> PERSONS UNDER AGE 21 IN POSSESSION OF TOBACCO PRODUCTS; <br /> AND POLICY DIRECTION ON TOBACCO SALES RESTRICTIONS OF <br /> EXISTING RETAIL SITES <br /> SUMMARY <br /> At the Council's May 5, 2020 meeting, the Council directed staff to prepare an <br /> amendment to the Municipal Code to add a tobacco retailer permitting' requirement. An <br /> ordinance is proposed that would amend Chapter 9.32 to require tobacco retailers to <br /> obtain a tobacco retailer permit, renew annually, and be subject to escalating fines, <br /> suspension, and revocation for violations of city, state and federal rules regarding <br /> tobacco retailing. An initial permit fee of $550 is proposed, with $450 for annual <br /> renewal. This fee would offset administration, education and monitoring costs. <br /> Council also requested information about the previously proposed Municipal Code <br /> amendment to authorize the Chief of Police to refer persons under the age of 21 to <br /> counseling if such person is found in possession of tobacco products two or more times. <br /> Counseling options include coordination with the Pleasanton Unified School District for <br /> school-age youth, and referral to Horizons Family Counseling for tobacco cessation if <br /> under 18 and enrolled in school up to 12th grade. <br /> Additional tobacco sales restriction information is provided regarding: how other <br /> communities have addressed existing tobacco stores and retailers located within <br /> proximity to youth-oriented uses; maps showing 1,000 and 500 foot distances from <br /> public schools, parks and recreational facilities; and information about City of <br /> Livermore's consideration of exemption from ban on flavored tobacco for flavored pipe <br /> tobacco and premium flavored cigars. <br /> In earlier discussions and in other communities, this is referred to as tobacco retailer licensing (TRL). <br /> However, to avoid confusion with the City's business license process. this is proposed to be referred to as <br /> a tobacco retailer permit. <br /> 1 <br />
