BACKGROUND The weed abatement program, provided in Government Code Sections 39560 — 39588, establishes a mechanism for assuring the removal of weeds, dirt, rubbish and refuse on specified properties that constitute a public nuisance. All of the owners of properties included in the attached Exhibit A have been mailed a notice to abate the nuisance on their parcels. In cases where there was an insufficient mailing address, the notice was posted conspicuously on the property. The notice included the public hearing date of June 2, 2020, an extended deadline of June 30, 2020, and a notice that weed abatement qualifies as an essential service. Weed abatement standards were also included. LPFD completed a proof of service to memorialize service of the documents. Property owners are accustomed to LPFD's standard, weed abatement deadline of May 31. Due to COVID-19, LPFD extended the deadline by 30 days to provide property owners ample time to complete the work. DISCUSSION At this hearing, the City Council is charged with considering the proposed abatement on the enumerated properties. Staff recommends that the City Council overrule any objections or amend the list of properties to be abated, and then order the abatement. The City Council should then adopt the attached resolution, as amended (if at all), that orders a contractor to abate the weeds on the properties attached in Exhibit A. After this hearing, Fire Inspectors will survey each parcel listed for compliance. If abatement has not occurred by June 30, 2020, a contractor will abate the weeds. If related litigation (e.g., an abatement warrant) is required, the property owners will be responsible not only for the abatement costs, but also all related attorneys' fees, expenses, and costs. At a public hearing this summer, staff will recommend that the City Council order that any unpaid abatement costs be a special assessment and lien imposed on the properties requiring abatement.
