Resolution No. PC-2003-39 <br />Page 2 <br />The proposed use will have adequate pazking to meet project demazid. <br />The bar would not play loud music, provide live entertainment, or provide <br />dancing areas for customers, thus avoiding possible adverse noise impacts <br />on the adjacent residents and businesses. Any areas of possible concern <br />have been conditioned so that the proposed use will meet all applicable <br />Municipal Code requirements and would be operated in anon-nuisance <br />manner. <br />3. The proposed conditional use will comply with each of the <br />applicable provisions of the Zoning Ordinance. <br />The site's Central Commercial zoning conditionally permits the establishment <br />of bazs. The proposed use complies with all relevant sections of this <br />ordinance. Sufficient parking would be provided to serve the customers of <br />the bar and to avoid parking on Ray Street and Walnut Drive. Granting a <br />conditional use permit to the applicant for a bar is consistent with the City's <br />ability to regulate zoning as listed in the Municipal Code Chapter 18.124 <br />"Conditional Uses." <br />WHEREAS, the Planning Commission determined that the proposed use would be <br />compatible with the surrounding businesses and will not detrimentally affect <br />the surrounding uses or properties, and that The Crown's presence in the <br />Downtown will be a benefit to the area. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-92, the application of Mari Kennard for conditional use <br />permit approval to serve beer, wine, and spirits after 10:00 p.m. (until 1:00 <br />a.m., Monday through Saturday, and until midnight on Sundays) for The <br />Crown British Pub and Restaurant located at 780 Main Street, subject to the <br />conditions shown in Exhibit "B," attached hereto and made part of this case by <br />reference. <br />Section 2. This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />THIS RESOLUTION ADOPTED BY THE PLANNING COMMISSION OF THE CITY <br />OF PLEASANTON ON THE 10TH DAY OF SEPTEMBER 2003 BY THE FOLLOWING <br />VOTE: <br />AYES: Commissioners Kameny, Maas, and Roberts <br />NOES: Commissioners Arkin and Sullivan <br />ABSENT: None <br />ABSTAIN: None <br />
