Resolution No. PC-2020-07 <br /> Page Eight <br /> 8. The restriction on approving a tentative subdivision map on land covered <br /> by a land conservation contract entered into pursuant to the California <br /> Land Conservation Act of 1965 (Williamson Act) is not applicable. <br /> The site is not covered by any land conservation contract, and so this finding can <br /> be made. <br /> 9. The discharge of waste from the proposed subdivision would not result in <br /> violation of existing requirements prescribed by the California Regional <br /> Water Quality Control Board (RWQCB). <br /> Existing and future homes will be connected to the City sanitary sewer system for <br /> conveyance to the sewer treatment plant. Stormwater runoff will be treated as <br /> part of the subdivision improvements. Thus, this subdivision will not result in <br /> violation of existing requirements prescribed by the California Regional Water <br /> Quality Control Board (RWQCB). The Planning Commission finds the proposed <br /> subdivision will meet this requirement. <br /> Section 4: The Planning Commission hereby recommends the following to the City <br /> Council: <br /> a. Find that the Project would not have a significant effect on the environment; <br /> b. Find that the proposed amendments (P19-0031) to the North Sycamore <br /> Specific Plan (NSSP) are appropriate and consistent with the General Plan; <br /> c. Find that the proposed Planned Unit Development rezoning (P19-0030) and <br /> development plan (PUD-135) are consistent with the General Plan and the <br /> purposes of the PUD Ordinance, and make the PUD findings as listed in <br /> Section 2, above; <br /> d. Find that the Vesting Tentative Subdivision Map application meets State law <br /> and the Zoning Ordinance of the Pleasanton Municipal Code (PMC) and <br /> make the required findings as listed in Section 3; <br /> e. Adopt a resolution approving the draft Negative Declaration; <br /> f. Adopt a resolution approving the proposed amendments to NSSP IP19-0031) <br /> pertaining to density, land use, and trail realignment as shown in Exhibit A; <br /> g. Introduce an ordinance for the Planned Unit Development rezoning (P19- <br /> 0030) and development plan (PUD-135) subject to the PUD Rezoning Map <br /> shown in Exhibit A-1 and draft conditions of approval listed in Exhibit A-2; and <br /> h. Adopt a resolution approving Vesting Tentative Subdivision Map 8528 subject <br /> to draft conditions of approval listed in Exhibit A-2 of PUD-135 rezoning and <br /> development approval. <br /> Section 5: This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> proposed subdivision includes the realigned public trail and an easement <br /> dedicated for the public's use of the trail.
