PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION N0. PC-2003-36 <br />RESOLUTION APPROVING THE APPLICATION OF MICHAEL <br />CALLAHAN FOR CONDITIONAL USE PERMIT APPROVAL, AS FILED <br />UNDER CASE PCUP-89 <br />WHEREAS, Michael Callahan has applied for a conditional use permit to operate an <br />event center at the site of the Ruby Hill Winery located at 1188 Vineyard <br />Avenue; and <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - A/OS/LDR <br />(Agriculture/Open Space/Low Density Residential) District; and <br />WHEREAS, at its duly noticed public hearing of August 13, 2003, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, the Planning Commission approved the negative declaration prepared for <br />this project; and <br />WHEREAS, the Plarming Commission made the following findings: <br />The proposed location of the conditional use is in accordance with <br />the objectives of the zoning ordinance and the purpose of the <br />district in which the site is located. <br />The operation of the event center would be considered complementary to <br />the operation of the winery. It and the barrel storage building were <br />designated as second-phase projects on the master site plan for the winery. <br />Its operation would be compatible with the winery and the homes of the <br />Ruby Hill development to the southeast. <br />The proposed location of the conditional use and the conditions <br />under which it would be operated or maintained will not be <br />detrimental to the public health, safety, or welfare, or materially <br />injurious to the properties or improvements in the vicinity. <br />Vehicular access is provided from the new aligned Vineyard Avenue, <br />which would include cleft-turn pocket for westbound traffic to the winery. <br />There is adequate capacity to handle the anticipated traffic requirements <br />for this facility. All events, performances, ceremonies, etc., taking place <br />at the event center must conclude operation by 11:00 p.m. There is a <br />general prohibition for outdoor music events/performances. However, <br />weddings and similar ceremonies with an acoustic-only musical/voice <br />
