RESOLUTION NO. 20-1148
<br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON
<br /> DECLARING THAT WEEDS, DIRT, RUBBISH, AND REFUSE UPON OR IN FRONT
<br /> OF CERTAIN DESCRIBED PROPERTIES WITHIN THE CITY OF PLEASANTON
<br /> CONSTITUTE PUBLIC NUISANCES AND THAT THEY BE ABATED, AND SETTING
<br /> A PUBLIC HEARING REGARDING THE ABATEMENT
<br /> WHEREAS, there is attached hereto and incorporated by reference herein as if fully set
<br /> forth a list of properties to which this resolution applies as Exhibit A; and,
<br /> WHEREAS, said list of properties specifically sets forth street, lot and block numbers
<br /> according to the official assessment map for each piece of property; and,
<br /> WHEREAS, the properties listed have, upon or in front of them, weeds, as defined by
<br /> Section 39561.5 of the Government Code, dirt, rubbish, or refuse; and,
<br /> WHEREAS, said weeds, dirt, rubbish, and refuse are a public nuisance in that they
<br /> constitute a fire hazard, or that said materials are noxious or dangerous and as such, are
<br /> detrimental to the health, safety and welfare of the City of Pleasanton and, as such, shall be
<br /> removed; and,
<br /> WHEREAS, the public nuisances referred to herein are recurrent and seasonal in
<br /> nature.
<br /> NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF PLEASANTON,
<br /> CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
<br /> SECTION 1. That the weeds, dirt, rubbish and refuse upon on or in front of the
<br /> properties described in Exhibit A, are declared a public nuisance and are to be abated and
<br /> removed pursuant to the procedure provided by Section 39560-39588 of the Government Code.
<br /> SECTION 2. That a public hearing shall be held Tuesday, June 2, 2020 at 7:00 p.m. in
<br /> the City Council Chamber, 200 Old Bernal Avenue, Pleasanton at which time property owners
<br /> having objections to the proposed removal of weeds, rubbish, refuse and dirt will be heard and
<br /> given due consideration.
<br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at
<br /> a regular meeting held on April 21, 2020.
<br /> I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing
<br /> resolution was adopted by the City Council at a regular meeting held on the 21st day of April
<br /> 2020 by the following vote:
