The updated Planning Commission minutes are provided as Attachment 2. <br /> Alternative. The Council could decide to not grandfather existing tobacco <br /> retail sites within the 1,000-foot buffer, and therefore prohibit all tobacco sales <br /> within the 1,000-foot buffer. This was not recommended on February 18th as <br /> (i) all other cities in Alameda County which adopted buffers exempted existing <br /> tobacco retail sites; and (ii) the prohibition on flavored tobacco products and <br /> electronic smoking devices and related paraphernalia will eliminate those <br /> products most appealing to youth. <br /> Effective Date. <br /> When presented on February 18th, it was recommended that the restrictions on the sale <br /> of flavored tobacco and electronic smoking devices and related paraphernalia be <br /> enforced 12 months after the effective date of the ordinance to give businesses the <br /> opportunity to sell existing inventory, change business models, and adjust store <br /> displays. At that time, it was also recommended that the provisions about the 1,000-foot <br /> buffer, TRL, and possession by persons under 21 were recommended to go into effect <br /> immediately. <br /> With the current COVID-19 shelter-in-place rules affecting tobacco stores (but not <br /> grocery stores, pharmacies, convenience stores and gas stations), the Council may <br /> want to consider start dates for enforcement to be a set period (e.g. 6 or 12 months) <br /> from when county's shelter-in-place orders are lifted, or other options, including: <br /> May 5, 2020 Introduce ordinance (1St reading) <br /> May 19, 2020 Adopt ordinance (2nd reading) <br /> June 20, 2020 Legal effective date (30 days after adoption of ordinance) <br /> Options for when to begin enforcement:4 <br /> Nov. 6, 2020 6 months after introduction <br /> Dec. 21, 2020 6 months after effective date <br /> Jan. 1, 2021 Beginning of new year (common effective date for new laws) <br /> May 6, 2021 12 months after introduction <br /> June 21, 2021 12 months after effective date - staff recommendation <br /> Unknown 6 months after shelter-in-place order lifted and retailers allowed <br /> to open for business <br /> Unknown 12 months after shelter-in-place order lifted and retailers <br /> allowed to open for business <br /> When Dublin adopted its prohibition on flavored tobacco and electronic smoking devices <br /> on January 14, 2020, it directed that enforcement not to begin until July 1, 2020 (about <br /> 6 months after introduction). When Alameda County adopted its prohibition on flavored <br /> 4 This would be for enforcement of ban on flavored tobacco and electronic smoking devices and related <br /> paraphernalia. The 1,000 foot buffer, TRL and prohibition on possession by persons under 21 would go <br /> into effect on June 20, 2020 per the above schedule. However, the roll-out of the TRL might be delayed <br /> due to COVID-19 disruptions. <br />
