In the Tri-Valley, Danville, Dublin, Livermore and San Ramon do not have any minimum <br /> package sizes or prices. <br /> Recommendation. Staffs recommendation is unchanged from February 18th - to not <br /> adopt minimum package sizes or prices. The recommendation is based on: <br /> 1) a 2018-19 UCSF study of Bay Area high schools that found that students in <br /> higher-income communities (Marin County) were using Juul and other higher- <br /> cost tobacco products, while low priced and small pack items were used more <br /> frequently in lower-income schools districts (Richmond). As Pleasanton's <br /> demographics are more similar to the Marin County type of community, it is <br /> expected that underage Pleasanton students are similarly using higher-cost <br /> products; <br /> 2) no other Tri-Valley city has adopted minimum package sizes or prices; and <br /> 3) that the ban on flavored tobacco and electronic smoking devices removes the <br /> most popular youth tobacco products. <br /> Alternative. If the Council desires to discuss or adopt minimum package sizes and <br /> prices, then based on (i) similarity of little cigars and cigarillos to cigarettes; (ii) the <br /> general consensus in other Alameda County communities; the following parameters are <br /> suggested for consideration: <br /> • Little cigars and cigarillos: Minimum 20 per pack and minimum $8 price <br /> • Cigarettes: Minimum $8 price <br /> • Cigars: Minimum 5 per pack, and minimum price of$8, unless at least $7 per <br /> individual cigar <br /> • No coupons, discounts or free items <br /> • Minimum prices include fees and taxes3 <br /> • Automatic annual Consumer Price Index (CPI) adjustment at 25¢ increments <br /> If the Council desires to adopt minimum package sizes and prices for tobacco products, <br /> it should discuss parameters and direct staff to draft text for a Municipal Code <br /> amendment to be returned to Council at a future meeting for consideration and <br /> introduction. <br /> Introduce Ordinance for Tobacco Restrictions Based on February 18, 2020 Action. <br /> Council's policy decisions on February 18th differed from the staff recommendation and <br /> the draft Ordinance presented at that time. Therefore, the proposed ordinance has been <br /> revised as set forth in Attachment 1 and is recommended to be introduced. <br /> Modifications from the earlier version include: <br /> A. §9.32.030: Prohibition on the sale of flavored tobacco to be imposed city-wide on <br /> both tobacco retailers and tobacco stores. <br /> 'The Cal. Dept. of Tax and Fee Administration lists the Cigarette and Tobacco Products Tax effective <br /> 7/1/2019 as: cigarette tax of$0.1435/cigarette($2.87/pack of 20s); and 59.27%state and federal excise <br /> taxes on the wholesale cost for other tobacco products.
