BACKGROUND <br /> MCINerizon presented an implementation plan to the City in June 2018 to install <br /> approximately 60 miles of fiberoptic cable throughout the City to support small cell <br /> wireless implementation and expand its existing ODN infrastructure. The City reviewed <br /> its proposed routing and identified that the planned installation expanded into residential <br /> areas which has recently been paved; the residential areas were flagged as being areas <br /> of concern. MCINerizon modified its implementation plan, presenting approximately 43 <br /> miles of new fiberoptic cable to primarily support ODN infrastructure and working <br /> primarily outside of the residential areas. <br /> The Public Utilities Code states that MCINerizon has the right to install the new <br /> fiberoptic within the public right-of-way. Under the Public Utilities Code Section 7901, <br /> the City has a right to exercise reasonable control as to the time, place, and manner in <br /> which the fiber installation is completed through the City's encroachment permit <br /> process. <br /> DISCUSSION <br /> The City's Engineering Department routinely works with existing utility companies for <br /> the replacement and maintenance of existing utility infrastructure through the utility <br /> encroachment permit process. City staff typically reviews a few miles of new <br /> improvements each year. But current City staff does not have the capacity to meet <br /> MCINerizon's anticipated schedule of installing all 43 miles of new facilities within one <br /> year. Consultant support will be necessary for encroachment permit review to identify <br /> the appropriate time, place, and manner in which the fiber is installed. It is anticipated <br /> that a full-time engineer will be required to keep up with the encroachment permit <br /> applications. Additional consultant support may be necessary to support the <br /> construction inspection of the approved permits. <br /> To support the encroachment permit review, a request for support was sent out to the <br /> City's current on-call consultants; Pakpour Consulting Group, Inc., was the only firm <br /> with available staff. The consultant assigned Steven Yee, the former Public Works <br /> Director for the City of Dublin, as the project manager. While working for the City of <br /> Dublin, Steven Yee managed the placement of utilities within the public right-of-way and <br /> oversaw several similar projects. <br /> Steven Yee currently supports the first round of encroachment permits under the <br /> existing on-call contract and has helped develop the submissions and review process. <br /> In addition, He is providing support to the construction inspection team. The City is <br /> working with MCINerizon to install conduits in advance of scheduled street resurfacing, <br /> as well as to locate alternative placements on streets that have been recently <br /> resurfaced. <br /> MCINerizon has entered a Master Encroachment Permit with the City that provides for <br /> the full cost recovery for the project. The hours for review and inspection for each <br /> encroachment permit are tracked daily and billed quarterly.
