THE CITY OF 1 2 _122 CITY COUNCIL AGENDA REPORT pLEASANTONo March 17, 2020 Community Development Planning Division TITLE: ADOPTION OF A RESOLUTION TO DENY AN APPLICATION FOR A PLANNED UNIT DEVELOPMENT (PUD) MAJOR MODIFICATION TO REMOVE AN EXISTING PUD (PUD-89-6) CONDITION OF APPROVAL PROHIBITING A DRIVE-THROUGH RESTAURANT ON "PAD B" WITHIN PHASE III OF THE ROSE PAVILION SHOPPING CENTER SUMMARY The proposed Major Modification to PUD-89-6 would remove a condition of approval prohibiting a drive-through restaurant on "Pad B" within Phase III of the Rose Pavilion Shopping Center. Elimination of the condition would facilitate the demolition of an existing oil change facility and the construction of a new approximately 1,649-square- foot drive-through Taco Bell restaurant and related site improvements on "Pad B." At this time, the scope of consideration is limited to the removal of the condition of approval prohibiting a drive-through restaurant use on "Pad B." While some initial analysis on the proposed Taco Bell is provided in this report for the City Council's consideration, no action would be taken on approval of the proposed Taco Bell itself at this time. Depending on the outcome of the City Council's consideration of this Major Modification, the proposed Taco Bell would potentially be considered by the Planning Commission as part of a separate future Conditional Use Permit (CUP) and Design Review (DR) application. While staff recommends denial of the Major Modification, the Planning Commission recommended approval of the Major Modification on January 22, 2020, and adopted a resolution approving the Major Modification subject to conditions of approval at their February 12, 2020 meeting. The Major Modification is now before the City Council for consideration. RECOMMENDATION Staff recommends the City Council: 1. Find the proposed Major Modification inconsistent with the goals, policies, and programs of the General Plan and the goals and strategies of the Climate Action Plan; and 2. Adopt a resolution denying PUD-89-06-08M, subject to the required findings (Attachment 1).
