Noise <br /> Patrons' voices and low-level background music would be the main noise sources generated <br /> from the subject use. The proposed hours of operation for the restaurant are 11:15 a.m. to <br /> 2:30 p.m. for lunch and 5:15 p.m. to 1:00 a.m. for dinner, Tuesdays to Sundays, with the <br /> restaurant being closed on Mondays. <br /> A proposed conditional use must be in accord with the objectives of the Zoning Ordinance. <br /> One of those objectives is to promote the stability of existing land uses that conform to the <br /> General Plan and to protect them from inharmonious influences and harmful intrusions. The <br /> proposed restaurant/bar would be subject to conditions of approval prescribed by the <br /> Downtown Hospitality Guidelines, such as keeping windows and doors closed when not being <br /> used for ingress/egress and prohibiting outside trash/recycling disposal between 11 p.m. and <br /> 8 a.m. In addition, as conditioned, the proposed use would need to comply with the City's <br /> noise regulations. Therefore, staff believes noise from the restaurant/bar would not significantly <br /> impact surrounding uses, including any nearby residential uses. <br /> Parking <br /> For property zoned C-C and located with the Downtown Revitalization District, the Municipal <br /> Code does not require any additional parking for a change in use. Parking for the <br /> restaurant/bar is provided in the rear parking lot and nearby on-street parking. Staff believes <br /> this parking would provide adequate parking for the proposed use. Should parking-related <br /> problems occur, staff has included a condition of approval which allows the Director of <br /> Community Development to refer the CUP back to the Planning Commission for possible <br /> mitigation measures. <br /> Police Department Review <br /> The Police Department has reviewed the proposed CUP and determined the proposed staffing <br /> would be sufficient to manage any security issues and additional security staff are not being <br /> requested at this time. A condition of approval would allow the Chief of Police to require <br /> security staff if future problems were to occur as a result of bar patrons' behavior within or <br /> outside of the tenant space. <br /> Pleasanton Downtown Association <br /> The Pleasanton Downtown Association's Downtown Vitality, Design & Historical Review <br /> Committee reviewed the proposed bar CUP on February 26, 2020. The Committee supported <br /> the bar CUP, subject to compliance with the City's Downtown Hospitality Guidelines. <br /> PROJECT SITE ALTERNATIVES <br /> As outlined in the above, staff believes the use, as proposed and conditioned, would be <br /> compatible with the surrounding businesses and would not detrimentally affect the surrounding <br /> uses or properties and recommends the Planning Commission approve the project. However, <br /> alternatives to the proposal that could be considered by the Planning Commission include: <br /> 1. Denial of the application. Such an action would preclude the applicant from serving <br /> alcohol past 11 p.m.; or <br /> 2. Approval of the application with modifications. The Planning Commission could approve <br /> the CUP, but with modified hours of operation, or with other changes to the proposal. <br /> P19-0431, 680 Main Street Planning Commission <br /> 7of8 <br />cy LD-P.3, <br /> regarding "Right to do Business" — this policy explicitly recognizes that "downtown operations" <br /> such as operation of businesses, special events and similar activities are not to be considered <br /> a nuisance, provided that they adhere to applicable noise and operational standards.
