These existing <br /> tobacco retailers and stores would be treated as legal non-conforming uses per <br /> PMC Ch. 18.120;12 <br /> • Apply this 1,000 foot buffer to public schools (not private schools or private <br /> tutoring centers), public parks (but not trails) and public recreation facilities (e.g. <br /> Senior Center); <br /> • Measure the 1,000 feet buffer from property line of public school, park or <br /> recreation facility to outer building wall of structure where new tobacco retailer or <br /> new tobacco store is proposed. The property line to building wall measurement <br /> " Existing tobacco retailers would not be able to sell flavored tobacco or electronic smoking devices and <br /> related paraphernalia as outlined in topics 1 and 2, above. <br /> 12 Legal non-conforming uses generally cannot expand or relocate; and right to operate terminates if <br /> operations cease for 90 days or more. <br />
