PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2003-17 <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF <br />THE CITY OF PLEASANTON TO AMEND CHAPTER 18.06 AND RELATED <br />SECTIONS OF THE CITY OF PLEASANTON MUNICIPAL CODE, AS FILED <br />UNDER CASE PRZ-17 <br />WHEREAS, the City of Pleasanton has filed an application to amend the Pleasanton Municipal <br />Code to comply with Assembly Bill 1866, which requires ministerial approval of <br />second unit uses in designated zoning districts without discretionary review or a <br />public heazing; and <br />WHEREAS, at its duly noticed public hearing of May 14, 2003 the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the City <br />staff concerning the amendment to the Municipal Code; and <br />WHEREAS, projects of this nature aze statutorily exempt from the requirements of the California <br />Envirorunental Quality Act (CEQA) pursuant to Section 21080.17 of the Califonaia <br />Public Resources Code; and <br />WHEREAS, the Planning Commission determined that the proposed amendment is in <br />compliance with Assembly Bill 1866. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Finds that off-street pazking requirements for second units should be consistent with <br />off-street parking requirements for all residential uses in the City of Pleasanton, <br />which prohibit tandem pazking and pazking in the front or street sideyazd. <br />Section 2. Recommends approval of Case PRZ-17, the application of the City of Pleasanton to <br />amend the Pleasanton Municipal Code to comply with Assembly Bill 1866, which <br />requires ministerial approval of second unit uses in designated zoning districts <br />without discretionary review or a public hearing, as shown on Exhibit "A," <br />attached hereto and made part of this case by reference. <br />Section 3. This resolution shall become effective immediately upon its passage and adoption. <br />
