The proposed location of the conditional use and the conditions <br />under which it would be operated or maintained will not be <br />detrimental to the public health, safety, or welfare, or materially <br />injurious to the properties or improvements in the vicinity. <br />The operation of the teen dance night on Sunday evenings would not <br />generate any unusual demands on the existing parking facilities available to <br />Masses. The proposed use would be operated entirely indoors and, for this <br />reason, the activities would not interfere with nearby office/commercial uses <br />or with the residents of the nearby Stoneridge Apartments. A condition has <br />been included that would require the applicant to control activities in the <br />parking lot and to mitigate any future nuisances that may arise from the <br />proposed use. <br />The proposed conditional use will comply with each of the <br />applicable provisions of the Zoning Ordinance. <br />The site's PUD zoning designation conditionally permits nightclub type <br />activities, which is interpreted to include the proposed teen dance nights. <br />The proposed use also complies with all relevant sections of the Pleasanton <br />Municipal Code including Chapter 6.44 (Teen-Age Dances). <br />WHEREAS, the Planning Commission determined that the proposed conditional use <br />would benefit the City by providing a supervised dance venue for high school <br />age individuals during the summer months and holidays. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-78, the application of Masses Sports Cafe and Night <br />Club for a conditional use permit to allow dances for teens (ages 14 through <br />18) from 8:00 p.m. to 12:00 midnight on Sunday nights during the summer <br />months and holiday weekends at the Masses Sports Cafe and Night Club <br />located at 6180 Stoneridge Mall Road, subject to the conditions shown in <br />Exhibit "B," attached hereto and made part of this case by reference. <br />Section 2. This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
