rescind the City Council's Project approvals due to alleged CEQA violations. Petitioners alleged <br /> that the Final SEIR had an incomplete air quality analysis related to the Stoneridge Apartment <br /> Complex on Stoneridge Mall Road, and that more time was needed for public consideration of <br /> the economic impact analysis. In September 2018, the City Council voted to rescind the EDZ <br /> approvals in order to perform supplemental air quality analysis for the EDZ project. Petitioners <br /> thus dismissed the lawsuit. <br /> e. 2019 Partial Recirculated Draft SEIR,Revised Final SEIR, and Project <br /> Approval <br /> In July 2019,the City prepared and circulated the following supplemental environmental <br /> analyses for public comment: <br /> • Health Risk Assessment <br /> • Updated Air Quality Technical Memorandum <br /> • Greenhouse Gas Analysis <br /> • Energy Resources Technical Memorandum <br /> • A Supplemental Recirculation Memorandum summarizing the methodology and the <br /> findings of the above four documents was also circulated, dated July 9, 2019 <br /> Together,these five documents comprise the Partial Recirculated Draft Supplemental <br /> Environmental Impact Report for the Project(the "Partial Recirculated Draft SEIR"). <br /> The City received nearly 300 public comments during the period that the Partial <br /> Recirculated Draft SEIR was recirculated,though only 14 letters raised substantive comments on <br /> the adequacy of the Partial Recirculated Draft SEIR, and most simply expressed support for or <br /> opposition to the project. The City prepared responses to those comments in October and <br /> November 2019. Those responses,together with the Draft SEIR and the Final SEIR(including <br /> all previous responses to comments prepared prior to the original approval of the Project) <br /> comprise the Revised Final Supplemental Environmental Impact Report for the Project <br /> ("Revised Final SEIR"). <br /> The City Council approved the Project and certified the Revised Final SEIR on February 4, <br /> 2020. <br /> II. PROJECT ENVIRONMENTAL REVIEW <br /> a. Preparation of the Revised Final SEIR pursuant to CEQA <br /> Before the Project was originally approved in 2017,the City properly determined that a <br /> supplement to the General Plan EIR and the 2012 SEIR should be prepared to analyze the <br /> potential environmental impact of the Project. <br /> CEQA Guidelines Section 15162 states that"When an EIR has been certified for a <br /> project, no subsequent EIR shall be prepared for that project unless the lead agency determines, <br /> on the basis of substantial evidence in the light of the whole record, one or more of the <br /> following: <br /> 1. Substantial changes are proposed in the project which will require major revisions of <br /> the previous EIR due to the involvement of new significant environmental effects or a <br /> substantial increase in the severity of previously identified significant effects; <br /> 2. Substantial changes occur with respect to the circumstances under which the project <br /> undertaken which will require major revisions of the previous EIR due to the <br /> involvement of new significant environmental effects or a substantial increase in the <br /> severity of previously identified significant effects; or <br />
