ORDINANCE NO. 2205 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AMENDING <br /> MUNICIPAL CODE CHAPTER 3.28 TO PROVIDE A LOCAL PREFERENCE FOR <br /> PLEASANTON-BASED BUSINESSES IN THE EVENT OF: (1) A TIE BID; AND (2) A BID <br /> CALCULATION PREFERENCE OF 5% UP TO $5,000 FOR A PLEASANTON-BASED <br /> BUSINESS IN THE ACQUISITION OF SUPPLIES, EQUIPMENT AND TRADE SERVICES <br /> WHEREAS, the proposed amendment to the Municipal Code to provide a local preference for <br /> Pleasanton-based businesses furthers the Pleasanton General Plan 2005-2025 Economic and Fiscal <br /> Element, Policy 5, that states: `Focus City efforts on supporting and assisting Pleasanton businesses <br /> success."; and <br /> WHEREAS, to implement the objectives of the Economic Development Strategic Plan (adopted <br /> by the City Council in 2013), the Economic Vitality Committee recommended, and the City Council <br /> adopted, a Coordinated Business Support Program as part of the 2019-2020 City Council Work Plan; <br /> and <br /> WHEREAS, the Coordinated Business Support Program includes an update of the City's <br /> purchasing practices to provide a preference to Pleasanton-based companies, described as: "If the <br /> procurement submissions are competitively matched in relation to qualifications, quality, experience <br /> and cost, the City will consider locality when selecting providers of goods and services. A local provider <br /> is a company that has a current City of Pleasanton business license and a physical location in <br /> Pleasanton. The City Council and / or City Manager may waive preference based on insufficient <br /> qualifications, quality or experience, or in the event of an emergency"; and the proposed ordinance <br /> addresses this element of the Program; and <br /> WHEREAS, at the Economic Vitality Committee's meeting of October 17, 2019, it unanimously <br /> recommended adoption of a local preference for Pleasanton-based businesses in the event of a tie bid, <br /> as well as a bid calculation preference of 5% up to $5,000, which as provided herein applies to the <br /> purchase of supplies, equipment and trade services (and does not apply to professional services). <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY <br /> ORDAIN AS FOLLOWS: <br /> Section 1. Finds that the amendment to the Municipal Code has no possibility to have a <br /> significant effect on the environment per Title 14 California Code of Regulations §15061(b)(3). <br /> Section 2. Amends Municipal Code Chapter 3.28 Purchasing and Disposition of Property as <br /> set forth in the attached Exhibit A. <br /> Section 3. A summary of this ordinance shall be published once within fifteen days after its <br /> adoption in "The Valley Times", a newspaper of general circulation published in the City of Pleasanton, <br /> and the complete ordinance shall be posted for fifteen days in the City Clerk's office within fifteen days <br /> after its adoption. <br /> Section 4. This ordinance shall be effective thirty days after its passage and adoption. <br />
