Resolution No. PC-98-53 Page 4 EXHIBIT B Conditions of Approval Case UP-98-30 1. The use shall SUbstantially conform to the site plan, floor plan, and narrative, Exhibit "A", dated "Received May 28, 1998" on file with the Planning Department, except as modified by the follOwing conditions. Minor changes to the plans may be allowed subject to the approval of the Planning Director if found to be in substantial conformance to the approved exhibits. 2. Classes shall conducted Monday through Friday, 3:00 PM to 9:30 PM and Saturday 9:00 AM to I :00 PM. 3. The total number of students inside the tenant space shall not exceed 25. 4. If additional activities, additional students or staff members beyond that initially proposed, or modifications to the hours of operation are desired, prior City review and approval is required. Such modifications shall be submitted to the Planning Director, who may approve the modification or refer the matter to the Planning Commission if judged to be substantial. 5. If the operation of the use results in major conflicts pertaining to parking, noise, traffic, or other impacts, at the discretion of the Planning Director, this conditional use permit may be referred to the Planning Commission for subsequent review at a public hearing. If necessary, the Commission may modify or add conditions of approval to mitigate such impact, or may revoke said conditional use permit. 6. Signage for the proposed use shall conform to the approved Oak Hills ShOpping Center sign program and shall be submitted for review and approval by the Planning and Building Department prior to installation. 7. The front and rear doors of the studio shall remain closed during all classes. 8. The applicant shall obtain all building and other applicable City permits for the project prior to the commencement of the use. 9. If the operation of the dance studio results in complaints regarding noise from neighboring tenants or residents, the applicant shall work with staff to reduce noise levels and associated impacts to an acceptable level. If the noise issue Cannot be resolved, the Planning Director shall refer the use permit to the Planning Commission for review at a public hearing. {end}
