Whether adequate public safety measures have been incorporated into the <br /> design of the`plan: • <br /> The subject parcel currently provides adequate access for police, fire, and other <br /> emergency vehicles. The new commercial building would be. equipped with <br /> automaticfiresuppression systems (sprinklers). Structures would be, required to <br /> meet the requirements of the California Building Code, Fire Code, other applicable <br /> City -codes,. and State of California energy and accessibility requirements. Site <br /> specific soils analyses would be conducted in•conjunction with'thebuilding permit <br /> review. <br /> Therefore, the City Council finds that the Project has beendesignedto <br /> incorporate adequate public safety measures. <br /> 7. Whether the plan conforms to the purposes of the PUD'District: <br /> The proposed' PUD development plan conforms to the purposes:of the PUD <br /> district. One of these purposes is to ensure that the desires-of the developer and <br /> the community- are understood and approved - prior- to commencement of <br /> construction. The Planning Commission finds that the Project implements the <br /> purposes of the PUD ordinance by providing a new commercial building and <br /> 'related site improvements that are well-designed and sited on the-subject parcel. <br /> In addition, the Project fulfills the-desires of the applicant, and -meets the City's <br /> General Plan goals and policies. The PUD process allows for ample input from the <br /> public and-for:an 'ultimate decision by the City Council regarding appropriateness <br /> of the proposed uses and development plan. - - -- <br /> The City Council finds that through the PUD process the Project los provided <br /> residents, the applicant and the City with a development plan that-optimizes the <br /> re-use'Of this-site in a sensitive.manner. <br /> SECTION 4 The City Council hereby approves the Project, as reflected in the <br /> plans dated August 27, 2019;- for the demolition of the existing -approximately 3,510- <br /> square-foot .restaurant building located at 6455 Owens Drive (formerly Denny's) and <br /> construction of an approximately 10,980-square-foot, single-story, multi-tenant <br /> commercial building and related site improvements, subject to the Conditions of Approval <br /> in Exhibit.B;_.attached hereto and incorporated into this ordinance by reference. <br /> SECTION 5 A summary of this ordinance shall be . published'-once within <br /> fifteen (15). days after its- adoption in "The Valley Times;"..a -newspaper of general <br /> circulation publishedin the City of Pleasanton, and -the- complete ordinance shall be <br /> posted for fifteen (15) days---in the City Clerk's office within fifteen-(15) days after its <br /> adoption. - <br />
