<br />IS. Modify the Specific Plan and PUD Development Plan and Conditions to: <br /> <br />(i) replace trees lost along Bernal Avenue with mature trees; and <br /> <br />(ii) save significant trees in the cottonwood grove and the finger tributary. <br /> <br />16. Modify the Specific Plan and PUD Development Plan to relocate the golf course holes <br />along the Arroyo de la Laguna easterly and to delay any development within a 300-foot <br />setback from the easterly top of bank of the Arroyo de la Laguna until completion of the <br />Zone 7 master plan study. <br /> <br />17. Modify the Specific Plan and PUD Conditions to disallow wood-burning fireplaces. <br /> <br />18. Modify the PUD Conditions, Development Agreement, Growth Management Agreement. <br />and associated agreements to: <br /> <br />(i) allow City review of all subsequent project impacts with City ability retained to <br />address any new/different impacts, including requiring additional mitigation <br />measures or modified land uses, when reviewing subsequent project applications; <br />and <br /> <br />(ii) allow the City to annually review the project growth management allocation as it <br />reviews short-term infrastructure/services, with the City retaining the ability to <br />adjust the growth allocation. <br /> <br />19. Modify the PUD Conditions (Condition 50.e.) to read as follows: <br /> <br />"e. Property Owner shall conduct a Preliminary Endangerment Assessment (PEA) in <br />consultation with California Department of Toxic Substance Control (DTSC) and <br />in consultation with DTSC Preliminary Endangerment Assessment Guidance <br />Manual within any areas to be directly affected by grading activities. Property <br />Owner shall implement applicable recommendations as may be legally required. <br />The PEA also shall include a radiololZical studv of the site. The radiololZical study <br />shall be undertaken in consultation with the RadiololZic Health Branch and the <br />Environmental Health InvestilZations Branch of the California Deoartrnent of <br />Health Services (CDHS). and in consultation with relevant Dortions of the <br />Multi-AlZencv Survev and Site InvestilZation Manual (MARSSIM). The Dublic <br />shall be invited to oarticiDate in the studv scoDinlZ at a Dublic hearinlZ. The study <br />shall include those areas of the site determined bv the CDHS to reQuire additional <br />study. Prooertv Owner shall imDlement the recommendations rnade bv CDHS <br />regardinlZ the SCODe and conduct of the radiololZical studv. Notice of comDletion <br />of the studv shall be lZiven as reQuired bv CEOA for a suoDlemental EIR and the <br />CEOA-customarv time shall be allowed for Dublic review of the studv Drior to anv <br />City action on the oroiect subseQuent to its comoletion.
