<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-99-77 <br /> <br />RESOLUTION FINDING THAT THE PROPOSED DEVELOPMENT AGREEMENT <br />BETWEEN NEW CITIES DEVELOPMENT GROUP AND THE CITY OF <br />PLEASANTON IS NOT CONSISTENT WITH THE GENERAL PLAN OR THE <br />HAPPY VALLEY SPECIFIC PLAN <br /> <br />WHEREAS, New Cities Development Group is proposing to enter into a Development <br />Agreement with the City of Pleasanton to provide water and sewer infrastructure <br />for existing residents in Happy Valley in exchange for vested rights to develop a <br />52-lot (51 new + I existing), single-family residential project within the North <br />Sycamore Specific Plan area; and <br /> <br />WHEREAS, zoning for the property is PUD-LDR (Planned Unit Development - Low Density <br />Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of October 13, 1999 the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, the project is covered by the Enviromnental Impact Report prepared and certified <br />for the North Sycamore Specific Plan; and <br /> <br />WHEREAS, the Planning Commission finds that the proposed development agreement <br />between the City of Pleasanton and New Cities Development Group is not <br />consistent with the North Sycamore Specific Plan and the General Plan. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Finds that the proposed development agreement between New Cities <br />Development Group and the City of Pleasanton for the proposed New Cities <br />project (PUD-97-12) within the North Sycamore Specific Plan area is not <br />consistent with the North Sycamore Specific Plan and the General Plan. <br />
