<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-99-74 <br /> <br />RESOLUTION FINDING THAT THE PROPOSED DEVELOPMENT AGREEMENT <br />BETWEEN SUMMERHILL HOMES AND THE CITY OF PLEASANTON IS NOT <br />CONSISTENT WITH THE GENERAL PLAN OR THE HAPPY VALLEY SPECIFIC <br />PLAN <br /> <br />WHEREAS, SummerHill Homes has proposed a development agreement in conjunction with <br />an application for Planned Unit Development (PUD) development plan approval <br />to allow the subdivision of an existing 158.4:t acre site into 79 lots ranging in size <br />from approximately 7,500 square feet to over one and one-half acres in size on the <br />Spotorno Ranch site which is approximately 158 acres located in the Happy <br />Valley Specific Plan area; and <br /> <br />WHEREAS, zoning for the property is PUD-SRDR/MDR/AG/OS (Planned Unit Development <br />- Semi Rural Density ResidentialIMedium Density Residential/Agricultural/Open <br />Space) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of October 13, 1999 the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, the project is covered by the Environmental Impact Report prepared and certified <br />for the Happy Valley Specific Plan; and <br /> <br />WHEREAS, the Planning Commission determined that the proposed PUD development plan <br />was not consistent with the Happy Valley Specific Plan; and <br /> <br />WHEREAS, the Planning Commission finds that the proposed development agreement <br />between SummerHill Homes and the City of Pleasanton is not consistent with the <br />Happy Valley Specific Plan and the General Plan. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section I. <br /> <br />Finds that the proposed development agreement between SummerHill Homes and <br />the City of Pleasanton for the proposed SummerHill project (PUD-99-04) within <br />the Happy Valley Specific Plan area is not consistent with the Happy Valley <br />Specific Plan and the General Plan. <br />
