<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-99-75 <br /> <br />RESOLUTION FINDING THAT THE PROPOSED PRE-ANNEXATION <br />AGREEMENT BETWEEN THE CITY OF PLEASANTON AND ALEX V. <br />SPOTORNO IS CONSISTENT WITH THE GENERAL PLAN AND THE HAPPY <br />VALLEY SPECIFIC PLAN <br /> <br />WHEREAS, Alex V. Spotorno is proposing to enter into a Pre-Annexation Agreement with the <br />City of Pleasanton for the Spotorno Ranch property located within the Happy <br />Valley Specific Plan area; and <br /> <br />WHEREAS, zoning for the property is PUD-SRDR/MDR/AG/OS (Planned Unit Development <br />- Semi Rural Density ResidentialIMedium Density Residential/AGricultural/Open <br />Space) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of October 13, 1999 the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, the proposed pre-annexation agreement provides Mr. Spotorno with the vested <br />right to proceed with a development of this property consistent with the current <br />General Plan and the Happy Valley Specific Plan, under current ordinances and <br />policies. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section I. <br /> <br />Finds that the Pre-Annexation Agreement between the City of Pleasanton and <br />Alex V. Spotorno for the Spotorno Ranch property located within the Happy <br />Valley Specific Plan area is consistent with the Happy Valley Specific Plan and <br />the General Plan. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
