<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-99-73 <br /> <br />RESOLUTION DENYING THE APPLICATION OF SUMMERHILL HOMES FOR <br />PUD DEVELOPMENT PLAN APPROVAL, AS FILED UNDER CASE PUD-99-04 <br /> <br />WHEREAS, SummerHill Homes has applied for Planned Unit Development (PUD) <br />development plan approval to allow the subdivision of an existing I 58.4:t acre site <br />into 79 lots ranging in size from approximately 7,500 square feet to over one and <br />one-half acres in size on the Spotorno Ranch site which is approximately 158 <br />acres located in the Happy Valley Specific Plan area; and <br /> <br />WHEREAS, zoning for the property is PUD-SRDR/MDR/AG/OS (Planned Unit Development <br />- Semi Rural Density Residential/Medium Density Residential/Agricultural/Open <br />Space) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of October 13, 1999 the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, the project is covered by the Environmental Impact Report prepared and certified <br />for the Happy Valley Specific Plan; and <br /> <br />WHEREAS, the Planning Commission determined that due to visual impacts and proposed <br />land use, the project is not consistent with the Happy Valley Specific Plan; <br />therefore, the Planning Commission was unable to make the required PUD <br />findings. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Denies the application of SummerHill Homes for Planned Unit Development <br />(PUD) development plan approval to allow the subdivision of an existing 158.4:t <br />acre site into 79 lots ranging in size from approximately 7,500 square feet to over <br />one and one-half acres in size on the Spotorno Ranch site which is approximately <br />158 acres located in the Happy Valley Specific Plan area. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
