The Meeting Minutes of October 23, 2019 were approved, as submitted. <br /> MEETING OPEN TO THE PUBLIC <br /> 2. Public Comment from the audience regarding items not listed on the agenda — <br /> Speakers are encouraged to limit comments to 3 minutes. <br /> There were no members of the audience wishing to address the Commission. <br /> PUBLIC HEARINGS AND OTHER MATTERS <br /> 3. P19-0130, Niraj and Harsha Gandhi, Appellants; Nadia and Fayyaz Malik, <br /> Applicants — Appeal of the Zoning Administrator's approval of an Administrative Design <br /> Review for the construction of an approximately 480-square-foot second story addition and <br /> exterior stairway (to accommodate an accessory dwelling unit) at the existing two-story <br /> residence at 7218 Moss Tree Way. Zoning for project is a PUD (Planned Unit <br /> Development). <br /> Associate Planner Jenny Soo presented the specifics of the item in the Agenda Report. <br /> Assistant City Attorney Julie Harryman referenced changes in state laws that will become <br /> effective January 2020. <br /> Commissioner Brown asked and confirmed with Ms. Harryman that the new state laws relating <br /> to Accessory Dwelling Units (ADUs) will come into effect January 2020. Ms. Harryman added <br /> that staff will bring proposed ordinances to be compliant with state law, but we are now <br /> operating under the City's current ordinance. <br /> Commissioner Ritter inquired whether the City has been liberal with the proposed project in <br /> regard to the new laws that will become effective. <br /> Ms. Harryman responded they have just begun to review the four or more bills signed into law <br /> and how they apply. The new laws affect such things as heights, setbacks, parking and other <br /> changes. <br /> Commissioner Brown inquired about timing of the new state law and how it applies to <br /> applications that have already been submitted and/or heard. <br /> Ms. Harryman confirmed the proposed project application came in under the current City's <br /> ordinance. <br /> Chair Allen inquired as to the instance where an application received in December does not <br /> undergo review by the Planning Commission until after January 2020. <br /> Ms. Harryman responded that the City would apply the new rules to the project. <br /> Ms. Soo then continued her presentation of the project. <br /> Planning Commission Minutes Page 2 of 12 November 13, 2019 <br />
