ATTACHMENT 2 <br /> RESOLUTION NO. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AMENDING <br /> THE PURCHASING PROCEDURES AND MANUAL TO ALLOW THE CITY TO CANCEL <br /> CONTRACTS WITH BUSINESSES WHICH VIOLATE THE PLEASANTON MUNICIPAL <br /> CODE, AS WELL AS FEDERAL OR STATE LAW <br /> WHEREAS, when the City is the purchaser of goods or services in the marketplace, it may <br /> impose its own requirements to reflect City values so long as allowed by federal and state law; <br /> and <br /> WHEREAS, because careful consideration has been given to the policies for the adoption <br /> of the Pleasanton Municipal Code, the City of Pleasanton seeks to hire businesses, vendors, <br /> contractors and suppliers which comply with the Municipal Code; and <br /> WHEREAS, an amendment to the Policy: Purchasing Procedures and Manual is proposed <br /> to reflect the City's policy that business which have contracts with the City comply with federal <br /> and state law, as well as the Pleasanton Municipal Code. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. Adopts an amendment to the Purchasing Procedures and Manual to add <br /> to Section 2. Ethical Guidelines, a new Subsection 2.8 as follows: <br /> 2.8. Contractors or vendors who violate federal, state or city laws or regulations may be <br /> subject to having their contracts cancelled by the City, or may be disqualified from <br /> bidding or submitted proposals for goods or services. <br /> SECTION 2. That the amendment to the Purchasing Procedures and Manual is exempt <br /> from environmental review under the California Environmental Quality Act per Title 14 California <br /> Code of Regulations §15061(b)(3). <br /> SECTION 3. City Clerk shall certify to the passage of this resolution and enter it into the <br /> book of original resolutions. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on December 17, 2019. <br /> I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br /> resolution was adopted by the City Council at a regular meeting held on December 17, 2019, by <br /> the following vote: <br /> Ayes: <br /> Noes: <br /> Absent: <br /> Abstain: <br />
