CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 04-009 AUTHORIZATION TO GRANT EASEMENTS TO ALAMEDA COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT ZONE 7 FOR MOCHO WELLS 3 AND 5 (SANTA RITA ROAD AT STONERIDGE DRIVE) WHEREAS, on March 7, 2000, the City Council of the City of Pleasanton authorized the City Manager to sign a Purchase Agreement with Prudential for property (two parcels) located along Stoneridge Drive at Santa Rita Road, totaling approximately two acres, and to sign an easement to Zone 7; and WHEREAS, Zone 7 contributed $168,000 towards the City's purchase of the property in exchange for the easement in order for Zone 7 to maintain up to two water well facilities, related pumping stations and pipelines on the property; and WHEREAS, Zone 7 has recently completed construction of one of the two wells and has requested the City to grant Zone 7 new easements, a waterline facilities easement (including the pump house) and a storm drain easement to operate its well and pumping facility, to reflect the as-built location of its facilities; additionally, Zone 7 has requested the City to grant it an access easement to its facilities; and WHEREAS, at is meeting of February 17, 2004, the City Council received a report from the Director of Public Works (SR:04:037) recommending that the City Council honor Zone 7's requests and that the City Manager be authorized to sign easements to that effect. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASEANTON RESOLVES AS FOLLOWS: Section 1: The City Manager is authorized to execute three Grants of Easement to Alameda County Flood Control and Water Conservation District Zone 7 for Mocho Wells 3 and 5 (Santa Rita Road at Stoneridge Drive). Section 2: This resolution shall become effective immediately upon its passage and adoption.
