WHEREAS, at the City Council meeting on December 17, 2019, no objections to the <br /> Report were made and the City approved the Report; and <br /> WHEREAS, section 39577 of the California Government Code provides that the <br /> abatement costs, including the costs for enforcement, are recoverable and constitute a special <br /> assessment against the parcels that are abated: and <br /> WHEREAS, section 39577 of the California Government Code further provides that after <br /> the assessment is made unless an exception applies, a lien attaches on the parcel upon <br /> recordation of the order confirming the assessment and the lien shall be included on the <br /> property owner's regular tax bill for the parcel requiring abatement; and <br /> WHEREAS, immediately upon its being placed on the assessments roll, the assessment <br /> shall constitute a special assessment against and a lien upon the property; and <br /> WHEREAS, the lien shall be subordinate to all existing special assessment liens <br /> previously imposed upon the same property and shall be paramount to all other fixed special <br /> assessment liens which may thereafter be created and all other liens except for state, county <br /> and property taxes with which it shall be upon a parity; and <br /> WHEREAS, the lien shall continue until the assessment and all interest, at six percent <br /> per annum, due and payable thereon are paid. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. The City Council approves the Report and confirms the imposition of a <br /> special assessment on parcel number 946-4585-026-00 in Pleasanton, California for the <br /> abatement costs, administrative costs, and attorney fees and costs accrued in the weed <br /> nuisance abatement on parcel number 946-4585-026-00 in the amount of $6,475 with interest <br /> accruing until the lien is satisfied. <br /> SECTION 2. Staff is directed to record this special assessment with the Alameda <br /> County Recorder's Office. <br /> SECTION 3. This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> SECTION 4. City Clerk shall certify to the passage of this resolution and enter it into <br /> the book of original resolutions. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on December 17, 2019. <br />
