THE CITY OF 8 <br /> CITY COUNCIL AGENDA REPORT <br /> pLEASANTON. <br /> December 17, 2019 <br /> Fire <br /> TITLE: ADOPT A RESOLUTION DECLARING THAT THE COSTS FOR WEED <br /> ABATEMENT, INCLUDING ABATEMENT, ADMINISTRATIVE COSTS, AND <br /> LEGAL FEES AND COSTS, ARE A SPECIAL ASSESSMENT AND LIEN <br /> IMPOSED ON PROPERTY OFF FONDRY COURT NEAR FOOTHILL ROAD, <br /> ASSESSOR'S PARCEL NUMBER 946-4585-026-00 <br /> SUMMARY <br /> The City Council declared that the weeds on properties throughout Pleasanton, <br /> including Assessor's Parcel Number (APN) 946-4585-026-00, located off Fondry Court <br /> near Foothill Road, were a fire hazard and ordered their abatement. Because the <br /> property owner failed to abate the weeds on APN 946-4585-026-00, and the parcel was <br /> partially surrounded by fences, the City sought, and was granted, a court order to enter <br /> the property and have the weeds removed. A city contractor abated the weeds on the <br /> parcel. The City sent the property owner an invoice but the owner did not pay. The <br /> attached resolution declares that the City's costs to abate weeds are a special <br /> assessment and lien imposed on the property. The unpaid amount will be an <br /> assessment collected on the property owner's tax bill. <br /> RECOMMENDATION <br /> Adopt the attached resolution overruling protests (if any), approving the Cost <br /> Accounting Report for the 2019 Livermore-Pleasanton Fire Department (LPFD) Weed <br /> Abatement Program, and declaring that the abatement costs, including the contractor's <br /> costs, administrative costs, and legal fees and costs, are a special assessment and lien <br /> imposed on the property requiring abatement. <br /> FINANCIAL STATEMENT <br /> The weed abatement costs, administrative costs equal to 100% of the contractor's costs <br /> to abate the nuisance, and legal fees and costs are fully recoverable and become a <br /> special assessment on the property owner's tax bill. All costs involved with the Weed <br /> Abatement Program are budgeted under Account #122-181-3378. <br />
