ATTACHMENT 4 <br />ORDINANCE NO. <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />ADDING A NEW MUNICIPAL CODE CHAPTER 18.109 RETAILERS OF <br />TOBACCO PRODUCTS AND PARAPHERNALIA, AND AMENDS §§9.24.020 <br />AND 18.44.080, TO PROHIBIT THE SALE AND DISPLAY . OF TOBACCO <br />PRODUCTS AND PARAPHERNALIA WITHIN 1,000 FEET OF PUBLIC <br />SCHOOLS, PUBLIC PARKS AND PUBLIC RECREATIONAL FACILITIES <br />WHEREAS, the California Department of Public Health (DPH) reports that there are <br />approximately 36,700 licensed tobacco retail stores in California, and the Alameda County <br />Tobacco Control Program advises there are 42 tobacco retail stores in Pleasanton; and <br />WHEREAS, DPH further reports that in 2008 about 90% of retail tobacco stores had <br />cigarette advertising material near the register, and studies show that exposure to. cigarette <br />advertising increases the likelihood that youth will start to smoke; and <br />WHEREAS; the Youth Commission;at its meeting on November 13, 2019, <br />recommended that ; the Economic Vitality Committee. at its meeting on -November. <br />21, 2019 recommended.that- ; Human Services Commission at its meeting on <br />December 4, 2019 recommended that ; and the Planning Commission at its <br />meeting of December 11, 2019 recommended that <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br />Section 1. .Finds that the amendment to the Municipal Code has no possibility to have <br />a significant effect on the environment per Title 14 California Code of Regulations <br />§15061(b)(3). <br />Section 2. Adds Municipal Code Chapter 18.109 Retailers of Tobacco Products and <br />Accessories, and amends §§9.24.020 and 18.44.080 as shown in the attached Exhibit A. <br />Section 3. A summary of this ordinance shall be published once within .fifteen (15 <br />days after its adoption in "The Valley Times",' a newspaper of general circulation. published in <br />the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the <br />City Clerk's office within fifteen (15) days after its adoption. <br />Section 4. This ordinance shall be effective on July 1, 2020. <br />The foregoing Ordinance was introduced at a regular meeting of the City Council of the <br />City of Pleasanton on ; 2020 by the following vote: <br />Ayes: <br />Noes: <br />Absent: <br />Abstain: <br />1 <br />
