ATTACHMENT 2 ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON ADDING A NEW MUNICIPAL CODE CHAPTER 9.31 TO PROHIBIT THE SALE OF FLAVORED TOBACCO PRODUCTS, INCLUDING MENTHOL CIGARETTES, AND FLAVORED LIQUIDS FOR E -CIGARETTES WHEREAS, the Alameda County Public Health Department (ACPH) in August 2019 advised that 87.6% of youth tobacco users in Alameda County reported using a flavored tobacco product, with fruit and sweet the most popular flavors; and WHEREAS, ACPH further stated that 81% of youth who ever tried tobacco choose flavored tobacco as their first tobacco product, with that type of sweet aroma hiding the taste of tobacco, thereby making it more appealing to new users; and WHEREAS, ACPH also provided information that: 48.4% and 54% of current smokers in middle school and high school, respectively, smoke menthol cigarettes; and 38.9% of all menthol smokers would try to quit if menthols were banned; and WHEREAS, the Youth Commission, at its meeting on November 13, 2019, recommended that ; the Economic Vitality Committee at its meeting on November 21, 2019 recommended Human Services Commission at its meeting on December 4, 2019 recommended NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Finds that the amendment to the Municipal Code has no possibility to have a significant effect on the environment per Title 14 California Code of Regulations §15061(b)(3). Section 2. Adds Municipal Code Chapter 9.31 Prohibition on the Sale of Flavored Tobacco Products, Including Menthol Cigarettes, and Flavored Liquids for E -Cigarettes as shown in the attached Exhibit A. Section 3. A summary of this ordinance shall be published once within fifteen (15 days after its adoption in "The Valley Times", a newspaper of general circulation published in the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City Clerk's office within fifteen (15) days after its adoption. Section 4. This ordinance shall be effective on July 1, 2020.
