The Economic Vitality Committee (EVC), at its meeting of November 21St, <br />recommended that the Youth Commission reconsider its recommendations in light of <br />what the EVC determined to be significant concerns raised by tobacco retailers. In <br />particular, the EVC felt that there were areas of potential compromise regarding youth <br />exposure to tobacco products in retail environments. <br />RECOMMENDATION <br />Discuss Youth Commission referral to consider recommending that the City Council <br />adopt ordinances to: (1) prohibit sale of flavored tobacco products; (2) prohibit sale of e - <br />cigarettes and paraphernalia; (3) restrict sale of tobacco products within 1,000 feet of <br />public schools, public parks and public recreation facilities; (4) require minimum pack <br />sizes and minimum pricing for some cigars and cigarettes; and (5) prohibit possession <br />of tobacco products by persons under 21 <br />FINANCIAL STATEMENT <br />There would be a decrease in sales tax revenues from both: <br />(a) tobacco products that are proposed to be banned (e.g. flavored tobacco and <br />electronic smoking devices); and <br />(b) related sales of gasoline, food, and other items that would normally be purchased <br />by persons who simultaneously buy tobacco products at gasoline stations, <br />convenience stores, grocery stores, etc., but who would go to other places to <br />make such purchases. <br />If adopted, City staff in the Police Department and Code Enforcement Division are <br />expected to use existing resources to enforce the restrictions. There will be some initial <br />staff resources needed to educate tobacco retailers about any adopted restrictions. <br />Page 2 of 9 <br />
