<br /> CONDITIONS OF APPROVAL
<br /> The applicant is hereby notified, as part of this approval, that (s)he is required to satisfy and
<br /> maintain compliance with the conditions of approval below. Where approval by the Director of
<br /> Community Development, Planning Division, Director of Engineering/City Engineer, City Attorney,
<br /> Chief Building and Safety Official, Fire Department or other City staff is required, review shall be
<br /> for compliance with all applicable conditions of approval, adopted policies and guidelines,
<br /> ordinances, laws and regulations, and accepted practices related to the approval. In addition to
<br /> complying with the conditions below, the applicant is required to comply with all applicable federal,
<br /> state, and local laws that pertain to this project whether or not specifically noted herein.
<br /> This approval is granted for: 1) rezoning the site from the C-N (Neighborhood Commercial) District
<br /> to the PUD-C (Planning Unit Development— Commercial) District; 2) Planned Unit Development
<br /> (PUD) Development Plan to demolish the existing 7-Eleven convenience store, auto service/smog
<br /> check building, and Shell service station canopy and construct an approximately 3,034-square-
<br /> foot 7-Eleven convenience store, 1,290 square-foot drive-through carwash building, 3,311-
<br /> square-foot Shell self-service station canopy, and related site improvements; and 3) Conditional
<br /> Use Permit (CUP) for the operation of a fuel station, a convenience store, and a drive-through
<br /> carwash located on Assessor Parcel Nos. (941 130903403 and 941 130903500) at 3760 and
<br /> 3790 Hopyard Road. Development shall be substantially as shown on the project materials listed
<br /> below:
<br /> a. Project plans, Exhibit B, prepared by PM Design Groups, Inc. for Anabi Real Estate
<br /> Development, LLC. dated "Received" on September 12, 2019 and kept on file in the
<br /> Planning Division of the Community Development Department.
<br /> b. Color and materials board prepared by PM Design Groups, Inc. for Anabi Real Estate
<br /> Development, LLC, dated August 7, 2019, and kept on file in the Planning Division of the
<br /> Community Development Department.
<br /> c. Arborist Report, prepared by HortScience/Bartlett Consulting, dated May 2019
<br /> d. Car Wash Noise Assessment, prepared by Illingworth & Rodkin, Inc., dated June 11, 2019
<br /> e. Shell Fuel Station—Health Risk Assessment, prepared by Illingworth & Rodkin, Inc., dated
<br /> March 5, 2019
<br /> The project materials listed above are collectively the "Approved Plans".
<br /> THIS APPROVAL IS GRANTED SUBJECT TO THE FOLLOWING CONDITIONS:
<br /> 1. APPROVAL AND REVISIONS: The proposed development shall be in substantial
<br /> conformance with the "Approved Plans", except as modified by the following conditions.
<br /> Minor changes to the plans may be allowed subject to the approval of the Director of
<br /> Community Development if found to be in substantial conformance with the approved
<br /> exhibits. Planning Division approval is required before any changes are implemented in
<br /> site design, grading, architectural design, house colors or materials, green building
<br /> measures, landscape material, etc.
<br /> 2. EXPIRATION — PLANNED UNIT DEVELOPMENT (PUD) DEVELOPMENT PLAN: The
