ORDINANCE NO. <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLE:ASANTON <br />AMENDING MUNICIPAL CODE CHAPTER 9.32 RESTRICTIONS ON <br />ACCESSIBILITY TO CIGARETTES AND OTHER TOBACCO PRODUCTS TO <br />PROHIBIT POSSESSION BY PERSONS UNDER THE AGE OF 21, AND BAN <br />THE SALE OF LOW-PRICED SMALL PACK TOBACCO PRODUCTS <br />WHEREAS, in 1991 the City Council prohibited cigarettes from being sold from vending <br />machines or given away as free samples to discourage use by minors (see Ordinance 1529); <br />and <br />WHEREAS, in 2015 the City Council prohibited persons under the age of 18 from <br />possessing tobacco products and smoking devices— including e -cigarettes (see Ordinance No. <br />2120); and <br />WHEREAS, smoking cigarettes and use of e -cigarettes by under-agE) youth continues <br />to be a public health concern, and in 2016 the smoking age in California was raised from 18 to <br />21; and <br />WHEREAS, underage youth are extremely price -sensitive and disproportionately <br />purchase small low-priced individual and small packs of tobacco products, and their purchases <br />decrease when pack sizes increase and prices increase; and <br />WHEREAS, the Youth Commission, at its meeting on November 13, 2019, <br />recommended that ; the Economic Vitality Committee at its meeting on November <br />21, 2019 recommended Human Services Commission at its meeting on <br />December 4, 2019 recommended <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br />Section 1. Finds that the amendment to the Municipal Code has no possibility to have <br />a significant effect on the environment per Title 14 California Code of Regulations <br />§15061(b)(3). <br />Section 2. Amends Municipal Code Chapter 9.32 Restrictions on Accessibility to <br />Cigarettes and Other Tobacco Products as shown in the attached Exhibit A. <br />Section 3. A summary of this ordinance shall be published once within fifteen (15 <br />days after its adoption in "The Valley Times", a newspaper of general circulation published in <br />the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the <br />City Clerk's office within fifteen (15) days after its adoption. <br />Section 4. This ordinance shall be effective thirty (30) days after its passage and <br />adoption, except the minimum pack size requirement shall go into effect on July 1, 2020. <br />1 <br />
