THE CITY OF 6 <br /> • <br /> gam Ili-�f -mks I CITY COUNCIL AGENDA REPORT <br /> pLE ASANTON. <br /> November 5, 2019 <br /> Community Development Department <br /> Planning <br /> TITLE: ADOPT A RESOLUTION APPROVING A PREANNEXATION AGREEMENT <br /> WITH GARY AND JANICE HABLUETZEL FOR SANITARY SEWER <br /> CONNECTION TO AN EXISTING RESIDENCE LOCATED AT 354 <br /> VIRGINIA WAY IN THE UNINCORPORATED REMEN TRACT <br /> SUMMARY <br /> Gary and Janice Habluetzel, property owners of 354 Virginia Way in the unincorporated <br /> area of Alameda County known as the Remen Tract, are requesting a connection to the <br /> City's sanitary sewer system because the existing septic system that serves the <br /> residence has failed. Prior to allowing properties outside the Pleasanton city limits to <br /> connect to City utilities, the City requires the property owners to enter into a <br /> preannexation agreement. If the preannexation agreement is approved, a party (the <br /> City, the County or the property owners) must apply for and receive an out-of-area <br /> service agreement from the Alameda County Local Agency Formation Commission <br /> (LAFCo) and approval of the Livermore-Amador Valley Water Management Agency <br /> (LAVWMA). <br /> RECOMMENDATION <br /> 1. Approve the Preannexation Agreement between Gary and Janice Habluetzel and the <br /> City of Pleasanton, subject to modifications approved by the City Manager and City <br /> Attorney, and authorize the City Manager to execute the agreement. <br /> 2. Authorize an application be filed with LAFCo for the extension of sanitary sewer <br /> services to this property. <br /> 3. Authorize connection of 354 Virginia Way (APN 946-1710-008-00) to the City <br /> sanitary sewer systems, provided: all connection work is done to the satisfaction of <br /> the City Engineer; all costs are borne by the property owner; and the proposed <br /> extension of City services is approved by LAFCo. <br /> FINANCIAL STATEMENT <br /> The property owners would be required to pay all costs associated with extending the <br /> sanitary sewer system, including City, County, and LAFCo permitting costs, and other <br /> agency fees and connection charges. <br />
