Ordinance No. 2197 <br /> Exhibit B <br /> Page 28 <br /> 20.26.050 Section 4.408 amended — Construction Waste Reduction, Disposal and <br /> Recycling. <br /> Section 4.408 is amended to read as follows: <br /> 4.408.1 Construction waste management. As provided in Municipal Code Chapter 9.21, <br /> "regulated projects" as defined therein shall comply with Municipal Code Chapter 9.21. Projects <br /> that are not regulated by Municipal Code Chapter 9.21 shall comply with CALGreen Section <br /> 4.408, as applicable. <br /> 20.26.060 Section 5.106 amended — Site Development. <br /> Section 5.106.1, is amended to read as follows: <br /> 5.106.1 Stormwater water pollution prevention. Newly constructed projects and additions <br /> which disturb less than one acre of land and are not part of a larger common plan of development <br /> shall prevent the pollution of stormwater runoff from construction activities and shall be in <br /> conformance with Municipal Code Chapter 9.14 Stormwater Management and Discharge Control, <br /> or any other requirements in effect at the time of application. <br /> 20.26.070 Section 5.408 amended — Construction Waste Reduction, Disposal and <br /> Recycling. <br /> Section 5.408 is amended to read as follows: <br /> 5.408.1 Construction waste management. [A] Additions and alterations to a building or tenant space that meet <br /> the scoping provisions in Section 301.3 for nonresidential additions and alterations, shall <br /> require verification that Universal Waste items such as fluorescent lamps and ballast and mercury <br /> containing thermostats as well as other California prohibited Universal Waste materials are <br /> disposed of properly and are diverted from landfills. A list of prohibited Universal Waste materials <br /> shall be included in the construction documents. <br /> Note: Refer to the Universal Waste Rule link at: <br /> http://www.dtsc.ca.gov/LawsRegsPolicies/Regs/upload/OEAR-A_REGS_UWR_FinalText.pdf <br /> 5.408.3 Excavated soil and land clearing debris. 100 percent of trees, stumps, rocks, and <br /> associated vegetation and soils resulting primarily from land clearing shall be reused or recycled. <br /> For a phased project, such material may be stockpiled on site until the storage site is developed. <br /> Exception: Reuse, either on- or off-site, of vegetation or soil contaminated by disease or pest <br /> infestation. <br /> Notes: <br /> 1.
