RESOLUTION NO. 19-1117 <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON ADOPTING <br /> A NEGATIVE DECLARATION FOR THE REZONING, PLANNED UNIT DEVELOPMENT <br /> (PUD) AND CONDITIONAL USE PERMIT FOR THE HOPYARD ROAD 7-ELEVEN <br /> CONVENIENCE STORE AND SHELL FUEL STATION REDEVELOPMENT LOCATED <br /> AT 3760 AND 3790 HOPYARD ROAD, AS FILED UNDER CASE NOS. PUD-134/P18- <br /> 0332/P18-0334 <br /> WHEREAS, on November 28, 2018, Brad Hirst("Applicant") submitted applications for the <br /> following at the 7-Eleven convenience store and Shell service station sites located at 3760 and <br /> 3790 Hopyard Road: 1) Rezoning from Neighborhood Commercial (C-N) District to Planned Unit <br /> Development—Commercial (PUD-C) District; 2) PUD Development Plan to demolish the existing <br /> 7-Eleven convenience store, Shell auto service/smog check building, and Shell service station <br /> canopy and construct an approximately 3,034-square-foot 7-Eleven convenience store, 1,290 <br /> square-foot drive-through carwash building, 3,311-square-foot Shell service station canopy, and <br /> related on-site improvements; and 3) Conditional Use Permit to operate a self-service gas station <br /> with a drive-through carwash and convenience store with the sale of alcoholic beverages <br /> ("Project"); and <br /> WHEREAS, the City of Pleasanton is the lead agency on the Project, and the City Council <br /> is the decision-making body for the proposed approval to carry out the Project; and <br /> WHEREAS, the Project is subject to review under the California Environmental Quality <br /> Act (CEQA), and an Initial Study and Negative Declaration have been prepared in accordance <br /> with Sections 15070 and 15072 of the CEQA Guidelines; and <br /> WHEREAS, the Initial Study concluded that the implementation of the Project would not <br /> result in any significant impacts to the environment; and <br /> WHEREAS, on August 1, 2019, Notice of Public Hearing and Notice of Intent (NOI) to <br /> Adopt a Draft Initial Study and Proposed Negative Declaration were sent to interested parties and <br /> property owners/residents in accordance with CEQA Guidelines Section 15072; and <br /> WHEREAS, the Planning Commission at its regular meeting on August 28, 2019, adopted <br /> Resolution PC-2019-21, determining that the proposed Negative Declaration is appropriate for <br /> the Project, making the requisite findings, and recommending to the City Council that the <br /> proposed Negative Declaration for the Project be approved; and <br /> WHEREAS, at a duly noticed public hearing on October 15, 2019, the City Council <br /> received and reviewed the Initial Study, dated July 31, 2019, received the recommendation of <br /> City staff and the Planning Commission, and the public was given the opportunity to comment on <br /> the environmental impacts of the Project's proposed rezoning; and <br /> WHEREAS, the City Council has reviewed and considered the Initial Study/Negative <br /> Declaration and intends to take actions on the Project in compliance with CEQA; and <br /> WHEREAS, the City Council finds that the Project will not individually or cumulatively have <br /> an adverse effect on the environment. <br />
