<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON
<br /> APPROVING APPLICATIONS FOR REZONING, PLANNED UNIT DEVELOPMENT
<br /> (PUD) AND CONDITIONAL USE PERMIT FOR THE HOPYARD ROAD 7-ELEVEN
<br /> CONVENIENCE STORE AND SHELL FUEL STATION REDEVELOPMENT LOCATED
<br /> AT 3760 AND 3790 HOPYARD ROAD, AS FILED UNDER CASE NOS. PUD-134
<br /> (PLANNED UNIT DEVELOPMENT), P18-0332 (CONDITIONAL USE PERMIT) AND
<br /> P18-0334 (REZONE)
<br /> WHEREAS, on November 28, 2018, Brad Hirst ("Applicant") submitted applications for the
<br /> 7-Eleven convenience store and Shell service station sites located at 3760 and 3790 Hopyard
<br /> Road for 1) rezoning from Neighborhood Commercial (C-N) District to Planned Unit Development
<br /> — Commercial (PUD-C) District; 2) PUD Development Plan to demolish the existing 7-Eleven
<br /> convenience store, Shell auto service/smog check building, and Shell service station canopy and
<br /> construct an approximately 3,034-square-foot 7-Eleven convenience store, 1,290 square-foot
<br /> drive-through carwash building, 3,311-square-foot Shell service station canopy, and related on-
<br /> site improvements; and 3) Conditional Use Permit to operate a self-service station with a drive-
<br /> through carwash and convenience store with the sale of alcoholic beverages ("Project"); and
<br /> WHEREAS, the site is designated Retail/Highway/Service Commercial/Business and
<br /> Professional Offices in the General Plan; and
<br /> WHEREAS, on April 10, 2019, the Planning Commission, following public notice,
<br /> conducted a work session regarding the Project; and
<br /> WHEREAS, on August 1, 2019, Notice of Public Hearing and Notice of Intent (NOI) to
<br /> Adopt a Draft Initial Study and Proposed Negative Declaration were sent to interested parties and
<br /> property owners/residents in accordance with California Environmental Quality Act (CEQA)
<br /> Guidelines Section 15072; and
<br /> WHEREAS, on August 28, 2019, the Planning Commission reviewed the Initial Study (IS)
<br /> and Negative Declaration (ND) prepared in accordance with Sections 15070 and 15072 of the
<br /> CEQA Guidelines; and
<br /> WHEREAS, on August 28, 2019, the Planning Commission, following public notice,
<br /> conducted a public hearing where it considered the written agenda report, public testimony,
<br /> related project materials, and adopted Resolution 2019-21, determining that the proposed
<br /> rezoning, development plan, and conditional use permit are appropriate for the site, making the
<br /> findings, and recommending to the City Council that Project be approved, and
<br /> WHEREAS, on October 15, 2019, the City Council held a duly noticed public hearing on
<br /> the Project and considered all public testimony, agenda reports, and related materials, and the
<br /> recommendations of City staff and the Planning Commission; and
<br /> WHEREAS, based on the Initial Study, a Negative Declaration was prepared for this
<br /> Project and was adopted by the City Council at its noticed public hearing on October 15, 2019;
<br /> and
<br /> WHEREAS, the City Council finds that the PUD rezoning and development, and the
<br /> conditional use permit are consistent with the General Plan and the purposes of the PUD
<br /> ordinance and Conditional Uses based on the considerations set forth in this ordinance.
