2. The proposed location of the conditional use and the conditions under which the <br /> conditional uses would be operated or maintained will not be detrimental to the <br /> public health, safety, or welfare, or materially injurious to the properties or <br /> improvements in the vicinity. <br /> The uses, as conditioned, would not be detrimental to the public health, safety, or welfare, <br /> or materially injurious to properties or improvements in the vicinity. The Project site has <br /> adequate vehicular access from Hopyard Road and W. Las Positas Boulevard. The <br /> Project would not generate a substantial increase in peak hour trips thereby limiting <br /> impacts on the surrounding uses and the local roadway network. Additionally, the Project <br /> would have the needed parking for patrons and employees. To help reduce noise levels, <br /> the Project will be required to meet the recommendations identified in the noise <br /> assessment prepared by Illingworth & Rodkin, Inc. including the proposed carwash dryers <br /> and vacuum units utilizing quieter systems to ensure compliance with the City's Noise <br /> Ordinance. Conditions of approval will ensure the Project will not be operated in a manner <br /> that is detrimental to the public health, safety, or welfare or be materially injurious to the <br /> properties or improvements in the vicinity. Therefore, the City Council finds that the Project <br /> will not cause health, safety or welfare concerns. <br /> 3. The proposed conditional use will comply with each of the applicable provisions of <br /> this chapter. <br /> The site would be rezoned to conditionally permit the Project's proposed uses. Chapter <br /> 18.124 of the Municipal Code states that, because of their unusual characteristics, <br /> conditional uses require special consideration so that they may be located properly with <br /> respect to their effects on surrounding properties. The conditions of approval will help to <br /> integrate the Project without adversely affecting the surrounding properties and the City in <br /> general. As with any use permit, this use can be revoked if the conditions are not met. As <br /> conditioned, the City Council finds that the proposed use permit would comply with all <br /> applicable provisions of the Zoning Ordinance. <br /> SECTION 5. The City Council hereby approves the Project, as reflected in the plans dated <br /> September 12, 2019, for the Hopyard Road 7-Eleven convenience store and Shell fuel station <br /> redevelopment located at 3760 and 3790 Hopyard Road, subject to the Conditions of Approval in <br /> Exhibit B, attached hereto and incorporated into this ordinance by reference. <br /> SECTION 6. A summary of this ordinance shall be published once within fifteen (15) <br /> days after its adoption in "The Valley Times," a newspaper of general circulation published in the <br /> City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City <br /> Clerk's office within fifteen (15) days after its adoption. <br /> SECTION 7. This ordinance shall be effective thirty (30) days after its passage and <br /> adoption. <br /> The foregoing Ordinance was introduced at a regular meeting of the City Council of the <br /> City of Pleasanton on October 15, 2019 by the following vote. <br /> Ayes: <br /> Noes: <br /> Absent: <br /> Abstain: <br />
