Ordinance No. 2198 <br /> Page 2 <br /> WHEREAS, the Authority has entered into agreements with electric power suppliers and <br /> other service providers and, based upon these agreements, the Authority provides electrical <br /> power to residents and businesses at rates that are competitive with those of the incumbent utility <br /> and the Authority plans to enter more agreements in the future. <br /> WHEREAS, the California Public Utilities Commission approved the implementation <br /> plan prepared by the Authority, and the Authority now provides service to customers within it <br /> member jurisdictions and under Public Utilities Code Section 366.2, customers have the right to <br /> opt-out of a CCA program and continue to receive service from the incumbent utility, and <br /> customers who wish to continue to receive service from the incumbent utility will be able to do so <br /> at any time. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 2. Elects to implement a Community Choice Aggregation program within <br /> Alameda County by and through the City's participation in the East Bay Community Energy <br /> Authority. <br /> SECTION 3. Finds, under Title 14 of the California Code of Regulations, Section <br /> 15061(b)(3), that this ordinance is exempt from the requirements of the California Environmental <br /> Quality Act (CEQA) in that it is not a Project which has the potential for causing a significant effect <br /> on the environment; therefore directs that a Notice of Exemption be filed with the Alameda County <br /> Clerk in accordance with the CEQA guidelines. <br /> SECTION 4. If any section, subsection, sentence, clause or phrase of this ordinance is <br /> for any reason held by a court of competent jurisdiction to be invalid, such a decision shall not <br /> affect the validity of the remaining portions of this ordinance and declares that it would have <br /> passed this ordinance and each section or subsection, sentence, clause and phrase thereof, <br /> irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases <br /> be declared invalid. <br /> SECTION 5. A summary of this ordinance shall be published once within fifteen (15) <br /> days after its adoption in The Valley Times," a newspaper of general circulation published in the <br /> City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City <br /> Clerk's office within fifteen (15) days after its adoption. <br /> SECTION 6. This ordinance shall be effective thirty (30) days after its passage and <br /> adoption. <br /> The foregoing Ordinance was introduced at a regular meeting of the City Council of the <br /> City of Pleasanton on October 1, 2019 by the following vote. <br /> Ayes: Councilmembers Brown, Narum, Pentin, Testa, Mayor Thorne <br /> Noes: None <br /> Absent: None <br /> Abstain: None <br /> Jerry Thorne, Mayor <br />
