71. UTILITY VAULTS: The applicant shall set existing and proposed utility vaults to the grade of <br /> adjacent curb and/or sidewalk as determined by and subject to the review and approval of the <br /> Director of Engineering/City Engineer and prior to City Council acceptance of public <br /> improvements. <br /> Subdivisions <br /> 72. MAINTENANCE OF COMMON IMPROVEMENTS: All common improvements including but not <br /> limited to storm drainage swales, gutters, inlets, outfalls, channels, retaining walls, soundwalls, <br /> fences, etc., shall be privately maintained by the property owners through the mechanism <br /> approved by the City in condition "Maintenance Agreement"below. All common improvements to <br /> be maintained specific to this project shall be identified as part of the Minor Subdivision approval. <br /> 73. MAINTENANCE OF PRIVATE IMPROVEMENTS: All private improvements including but not <br /> limited to storm drainage swales, gutters, inlets, outfalls, channels, retaining walls, soundwalls, <br /> fences, etc., shall be privately maintained by the property owners through the mechanism <br /> approved by the City in condition "Maintenance Agreement" below. All private improvements to <br /> be maintained specific to this project shall be identified as part of the Minor Subdivision approval. <br /> 74. PARCEL MAP APPROVAL: The applicant shall submit to the Engineering Department one <br /> completely signed Mylar copy of the parcel map, one signed copy of the improvement plans, one <br /> signed copy of the Subdivision Agreement, one signed copy of the Maintenance Agreement, one <br /> signed copy of the Stormwater Operations and Maintenance Agreement, prior to the City <br /> Engineer's approval of the parcel map. If existing buildings or structures on-site are to be <br /> demolished or retained, or existing utilities to be relocated, the applicant shall obtain the <br /> necessary permits from the Building and Safety Division and complete all work prior to <br /> recordation of the parcel map. <br /> 75. STREET DEDICATIONS AND GRANTS OF EASEMENTS: All dedications, open offers of <br /> dedication, or grants of easements to the City shall be dedicated on the face of the parcel map <br /> unless otherwise approved by the Director of Engineering/City Engineer. <br /> Agreements and Covenants <br /> 76. SUBDIVISION AGREEMENT: The applicant shall enter into a subdivision agreement with the <br /> City agreeing to construct and complete all improvements necessary to serve the subdivision. <br /> The agreement shall be executed and submitted to the City prior to approval of the parcel map. <br /> As part of the agreement, the applicant shall provide securities acceptable to the City, <br /> guaranteeing construction of the required improvements. <br /> 77. DEED RESTRICTION AND DISCLOSURE: Prior to recordation of the parcel map, any deed <br /> restrictions required by specific Planning or Engineering approval, or Specific Plan, shall be <br /> recorded on all applicable lots covered by this approval. Wording for all disclosures, deed <br /> restrictions, and clauses shall be submitted to the City Attorney and Director of Engineering/City <br /> Engineer for review and approval prior to City Council approval of the final map or prior to the <br /> Director of Engineering/City Engineer's approval of the parcel map for this development and shall <br /> be concurrently recorded by separate instrument. <br /> 78. MAINTENANCE AGREEMENT: Applicant shall create a maintenance agreement, or other <br /> mechanism agreed upon by applicant and City, which sets forth the maintenance areas and <br /> responsibilities for development. The maintenance agreement may be a separate recorded <br /> document, or may be included in the Condition, Covenants and Restrictions (CC&Rs) for the <br /> development, subject to review and approval by the City Attorney, Engineering Department and <br /> PUD-133 City Council <br /> Page 12 of 18 <br />
