Therefore, the <br /> Planning Commission finds this use will not cause health, safety or welfare <br /> concerns. <br /> 3. The proposed conditional use will comply with each of the applicable <br /> provisions of this chapter. <br /> The site would be rezoned to conditionally permit the subject uses. Chapter 18.124 <br /> of the Municipal Code states that, because of their unusual characteristics, <br /> conditional uses require special consideration so that they may be located properly <br /> with respect to their effects on surrounding properties. The conditions of approval <br /> will help to integrate the proposed uses without adversely affecting the surrounding <br /> properties and the City in general. As with any use permit, this use can be revoked <br /> if the conditions are not met. As conditioned, the Planning Commission finds that <br /> the proposed use permit would comply with all applicable provisions of the Zoning <br /> Ordinance. <br /> Section 4: The Planning Commission hereby recommends the following to the City <br /> Council: <br /> a. Adopt the IS/ND prepared for the proposed Project; <br /> b. Approve the rezoning of the Project site located at 3760 and 3790 Hopyard <br /> Road from C-N (Neighborhood Commercial) District to PUD-C (Planned Unit <br /> Development — Commercial) District as shown in the attached Zoning Unit Map <br /> No. 504; <br /> c. Approval the PUD development plan for the Project as reflected in the plans <br /> dated August 7, 2019, subject to the Conditions of Approval in Exhibit A, <br /> attached hereto and incorporated into this resolution by reference; and <br /> d. Approval the Condition Use Permit for the operation of the Project as reflected <br /> in the plans dated August 7, 2019, subject to the Conditions of Approval in <br /> Exhibit A, attached hereto and incorporated into this resolution by reference. <br /> Section 5: This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of <br /> Pleasanton at a regular meeting held on August 28, 2019, by the following vote: <br /> Ayes: Commissioners Allen, Balch, Brown, O'Connor, Pace <br /> Noes: None <br /> Absent: Commissioner Ritter <br /> Abstain: None <br />operties or improvements in the vicinity. <br /> The uses, as conditioned, would not be detrimental to the public health, safety, or <br /> welfare, or materially injurious to properties or improvements in the vicinity. The proposed uses would not generate a substantial increase in peak <br /> hour trips thereby limiting impacts on the surrounding uses and the local roadway <br /> network. Additionally, the proposed Project would have the needed parking for <br /> patrons and employees. To help reduce noise levels, the proposed Project will be <br /> required to meet the recommendations identified in the noise assessment prepared <br /> by Illingworth & Rodkin, Inc. including the proposed carwash dryers and vacuum <br /> units utilizing quieter systems to ensure compliance with the City's Noise <br /> Ordinance. Conditions of approval will ensure the subject use will not be operated <br /> in a manner that is detrimental to the public health, safety, or welfare or be <br />immed or pruned without prior approval by the City <br /> Landscape Architect. <br /> b. Utilize best efforts to locate any new utility trenches outside of the existing canopy of <br /> the trees to be saved.
