Resolution No. 19-1110 <br /> Page Two <br /> Some of the objectives of the zoning ordinance are to: foster a harmonious, convenient, workable <br /> relationship among land uses, protect existing land uses from inharmonious influences and <br /> harmful intrusions, and ensure that public and private lands ultimately are used for the purposes <br /> which are most appropriate and beneficial to the City as a whole. As conditioned, the City Council <br /> finds the proposed axe lounge would be consistent with these objectives and would create an <br /> appropriate indoor recreation space for the general public. The proposed lounge would be <br /> operated so as to not impact or interfere with the surrounding uses in that the number of patrons <br /> and hours of operation would not generate substantial noise, parking demand, or traffic. <br /> The subject site is zoned PUD-C (Planned Unit Development — Commercial) District, which <br /> generally has the characteristics of the City's C-S (Commercial Service) District. The subject <br /> shopping center has several multi-tenant buildings with a variety of uses. The proposed use would <br /> be complementary and compatible with the existing uses in the shopping center. The proposed <br /> activities will be conducted exclusively indoors and on a property with an adequate circulation <br /> system and parking supply to support the use. The applicant will also be required to mitigate any <br /> future nuisances that may occur as a result of the proposed use. As conditioned, the City Council <br /> finds the proposed axe throwing lounge will be consistent with these objectives and zoning district <br /> purposes. <br /> B. That the proposed location of the conditional use and the conditions under <br /> which it would be operated or maintained will not be detrimental to the public health, <br /> safety, or welfare, or materially injurious to the properties or improvements in the vicinity. <br /> As conditioned, the City Council finds the proposed axe-throwing lounge would make a good <br /> neighbor, since all of its proposed activities would occur indoors, would generally peak outside of <br /> the operating hours of nearby commercial and office uses, and would include sound-insulated <br /> walls to help mitigate any potential noise impacts associated with the use. Indoor recreational <br /> uses generally do not subject surrounding uses to heavy truck traffic, hazardous odors, high noise <br /> levels, or other objectionable influences. If the recommended conditions of approval are followed, <br /> the City Council finds the proposed axe-throwing lounge would not be detrimental to the <br /> adjacent/nearby uses or residences. The operation of the project would include adequate <br /> measures to ensure the safety of patrons and the general public, including instruction and <br /> supervision for the axe-throwing activity, and provisions to ensure the responsible consumption <br /> of alcohol by participants. All streets around the subject site are designed per City standards to <br /> provide safe ingress and egress into and out of the site. In addition, there is adequate off-street <br /> parking available to meet the project's demand. Conditions have also been included that would <br /> require the applicant to mitigate any future nuisances as a result of the proposed use. <br /> C. That the proposed conditional use will comply with each of the applicable <br /> provisions of the zoning ordinance. <br /> The site's zoning conditionally permits the establishment of bowling alleys, pool halls, indoor <br /> bocce courts, and other similar uses such as indoor axe-throwing lounges. Granting a CUP for <br /> the proposed axe-throwing lounge would be consistent with the City's ability to regulate zoning as <br /> listed in Chapter 18.124 of the Municipal Code. In addition, the City Council finds that, as <br /> conditioned, the proposed use will comply with all provisions and requirements of the City's zoning <br /> ordinance and the approved PUD for Valley Plaza shopping center. <br />
