Resolution No. 19-1110 Page Two Some of the objectives of the zoning ordinance are to: foster a harmonious, convenient, workable relationship among land uses, protect existing land uses from inharmonious influences and harmful intrusions, and ensure that public and private lands ultimately are used for the purposes which are most appropriate and beneficial to the City as a whole. As conditioned, the City Council finds the proposed axe lounge would be consistent with these objectives and would create an appropriate indoor recreation space for the general public. The proposed lounge would be operated so as to not impact or interfere with the surrounding uses in that the number of patrons and hours of operation would not generate substantial noise, parking demand, or traffic. The subject site is zoned PUD-C (Planned Unit Development — Commercial) District, which generally has the characteristics of the City's C-S (Commercial Service) District. The subject shopping center has several multi-tenant buildings with a variety of uses. The proposed use would be complementary and compatible with the existing uses in the shopping center. The proposed activities will be conducted exclusively indoors and on a property with an adequate circulation system and parking supply to support the use. The applicant will also be required to mitigate any future nuisances that may occur as a result of the proposed use. As conditioned, the City Council finds the proposed axe throwing lounge will be consistent with these objectives and zoning district purposes. B. That the proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. As conditioned, the City Council finds the proposed axe-throwing lounge would make a good neighbor, since all of its proposed activities would occur indoors, would generally peak outside of the operating hours of nearby commercial and office uses, and would include sound-insulated walls to help mitigate any potential noise impacts associated with the use. Indoor recreational uses generally do not subject surrounding uses to heavy truck traffic, hazardous odors, high noise levels, or other objectionable influences. If the recommended conditions of approval are followed, the City Council finds the proposed axe-throwing lounge would not be detrimental to the adjacent/nearby uses or residences. The operation of the project would include adequate measures to ensure the safety of patrons and the general public, including instruction and supervision for the axe-throwing activity, and provisions to ensure the responsible consumption of alcohol by participants. All streets around the subject site are designed per City standards to provide safe ingress and egress into and out of the site. In addition, there is adequate off-street parking available to meet the project's demand. Conditions have also been included that would require the applicant to mitigate any future nuisances as a result of the proposed use. C. That the proposed conditional use will comply with each of the applicable provisions of the zoning ordinance. The site's zoning conditionally permits the establishment of bowling alleys, pool halls, indoor bocce courts, and other similar uses such as indoor axe-throwing lounges. Granting a CUP for the proposed axe-throwing lounge would be consistent with the City's ability to regulate zoning as listed in Chapter 18.124 of the Municipal Code. In addition, the City Council finds that, as conditioned, the proposed use will comply with all provisions and requirements of the City's zoning ordinance and the approved PUD for Valley Plaza shopping center.
