RESOLUTION NO. PC-2019-19 <br /> A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br /> PLEASANTON APPROVING THE APPLICATION FOR DESIGN REVIEW TO <br /> CONSTRUCT AN APPROXIMATELY 7,432-SQUARE-FOOT SINGLE-FAMILY <br /> RESIDENCE WITH AN APPROXIMATELY 1,603-SQUARE-FOOT GARAGE ON A <br /> VACANT LOT LOCATED AT 4108 FOOTHILL ROAD, AS FILED UNDER <br /> CASE NO. P19-0059 <br /> WHEREAS, on March 6, 2019, Mark B. Lee ("Applicant"), on behalf of Abdul <br /> Chashmawala ("Property Owner"), applied for a Design Review approval under Case <br /> No. P19-0059 for an approximately 7,432-square-foot single-family residence with an <br /> approximately 1,603-square-foot garage on a vacant lot ("Project") located at <br /> 4108 Foothill Road ("Property); and <br /> WHEREAS, the Property is designated Rural Density Residential in the General <br /> Plan; and <br /> WHEREAS, the Property is located in the West Foothill Road Corridor Overlay <br /> District (WFRCOD) and was approved as part of PUD-87-19 and modified by <br /> PUD-87-19-04M with a zoning designation of PUD-LDR/RDR/OS; and <br /> WHEREAS, on July 15, 2019, the Applicant resubmitted plans including <br /> modifications to the building design; and <br /> WHEREAS, on July 15, 2019, the application was deemed complete; and <br /> WHEREAS, on August 14, 2019, the Planning Commission held a duly-noticed <br /> public hearing and considered the written agenda report, relevant exhibits, <br /> recommendations of City staff concerning this application, and received testimony from <br /> interested parties; and <br /> WHEREAS, the City Council adopted a Mitigated Negative Declaration for <br /> PUD-87-19 pursuant to the requirements of CEQA. The Mitigated Negative Declaration <br /> included mitigation measures which would be required to be implemented by the subject <br /> application, and which would ensure that the project would have less-than-significant <br /> environmental impacts. <br /> NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City <br /> of Pleasanton, based on the entire record of proceedings, including the oral and written <br /> staff reports and all public comment and testimony: <br /> Section 1: Findings for P19-0059 <br /> With respect to the Design Review application, P19-0059, the Planning Commission <br /> makes the following findings and determinations with respect to each of the criteria for <br /> approval of Design Review as required by Section 18.20.030 of the Pleasanton <br /> Municipal Code (PMC): <br />ng <br /> Commission for their subsequent review at a public hearing. If necessary, the Planning <br /> Commission may modify or add conditions of approval to mitigate such impacts, or may revoke <br /> said conditional use permit. <br /> P19-0140 Planning Commission <br /> Page 2 of 3 <br />wledging the plan check fees may be forfeited in the event the approval is overturned on <br /> appeal, or the design is significantly changed as a result of the appeal. In no case will a building <br /> permit be issued prior to the expiration of the appeal period. <br /> 4. LIABILITY AND INDEMNIFICATION: To the extent permitted by law, the project applicant shall <br /> hold harmless, defend (with counsel acceptable to the City), and indemnify the City, its City <br /> Council, its officers, commissions, employee and agents from and against any claim, action, or <br />ch high by 1- <br /> inch stroke. In all cases address numerals shall be of contrasting background and clearly visible <br /> in accordance with the Livermore-Pleasanton Fire Department Premises Identification Standards. <br /> This may warrant field verification and adjustments based upon topography, landscaping or other <br /> obstructions. <br /> P19-0092 Planning Commission <br /> Page 7 of 9 <br />age 4 of 9 <br />
